WARRANTS: How to know if one is placed on you?
    #7495963 - 10/08/07 12:22 AM (16 years, 3 months ago)

Alright, so here's the issue that's been going on here...

Almost every single day, there has been a cop sitting around ALL FUCKING DAY right outside my house. He doesn't pick my next door neighbor's house, he doesn't pick my other neighbor's house--no no, he specificially picks MY house, to park directly outside of, and carry on his business.

I've come outside and asked him if there is any problem. He says he's just "patrolling the neighborhood." Now here's the thing--I DON'T live in the city, I live in a suburb, and I live in a small community where maybe ONE car would go by every hour or so my question is: What the fuck could he possibly be observing???

I didn't think anything of it. Who gives a fuck, right? Well, here's the thing... a few jehova's witnesses have been coming by my house too. okay okay, this means nothing, EXCEPT for the fact that they specifically drive to MY HOUSE, and MY HOUSE ONLY, and knock on MY DOOR AND NOBODY ELSE'S. VERY CREEPY. I decided to watch them from atop my window and observed this behind the blinds of my room. I asked my housemates who they were, and they mentioned they had been coming here for several weeks--the same length of time as the police officer has been around.

Alright, so the only two reasons I can think of are:

1) I've been visiting friends of mine in jail quite frequently. In order to do so, I've had to swipe my driver's license in the police officer's computer. Could frequent visits be enough cause for an officer to start pending investigation?

2) Somebody probably made an anonymous phone call to the police... now the thing is, I think I know who they are and this person probably hates me... he probably fabricated and exaggerated that I was a dealer or some shit from an "anonymous" phone... exactly how reliable would this call be? Would it be enough to get a search warrant placed on me, my car, my house, my computer, my mail, EVEN IF THERE IS NO REASON OR EVIDENCE TO BELIEVE I WOULD OTHERWISE BE INVOLVED IN ILLEGAL ACTIVITIES???

If I go to the police station and make up some lie that I need to get my fingerprints done for work or something like that (I've only had them done twice before, for small-time misdemeanors years and years ago)... then are they legally obligated to tell me if I have a warrant placed on me, if I ask?

I think all this is crazy. If the feds knew what I was REALLY doing (smoking weed occasionally, etc.), they would think I was one big fucking joke compared to anybody else in "da game." So... do you think it's plausable that they are attempting to build a case?

Final question: How likely is it that they have been listening in on conversations between me and my jailmates to build up a case for me?

Can't you just ask the JWs if they are police officers or affiliated with law enforcement, then they have to tell you?

And as for the cop outside... Maybe you should just put a sofa out there on your lawn and sit outside in your underwear all day?

He'd at least move down the block, or you know some thing's up.

Have you talked about assassinating Bush recently?

Cops aren't that stupid though. If they're sitting right outside your ho use, they're probably checking out someone across the street.

Put on a tinfoil hat, go outside, sneak over to the cop car, give the cop a tinfoil hat and say that for your safety, he has to put it on, then proceed to ask if they know that you know what's really in Area 51.

haha nice second suggestion...

Cops aren't required by law to tell you if they are police officers though, in regards to your first.

I'm really mostly worried about a possible warrant on my car or my mail yet... I really need to find out somehow, someway, if there is one placed on me goddammit!!! :mad2:

err well, not necessarily... there are no street lamps around my house, and when i said he parks them in my house during the day i really meant to say he was primarily parking there at night, and turns off all his lights so nobody can see him... apparently he had been sitting outside my house for presumably a fair amount of time without me even noticing him, and i wouldn't have unless my roommate pulled up in the garage and mentioned him, adding: "He's been there for days, you know that???"

I dunno, there WAS a 911 call a couple houses over a couple weeks ago too (I think based on what I heard it might have been a domestic violence case) so, it might not be me.

I think ultimately this comes down to an issue of protected speech VS intent. If the police tapped into your phone and overheard plans of ongoing future activities, is that enough cause to justify a warrant, even if there is no other external evidence to support possible ongoing criminal activity?

Call the cop shop and ask?

"Hi, I was watching COPS on TV, and they arrested a guy for a warrant that he didn't even know he had. The cop on the show said it happens a lot where people have a warrant and don't know it. Is it possible for you to check to make certain that I don't have anything outstanding? I would rather take care of it now, if I have one, rather than have it sprung on me unexpectedly."

In response to the op, while the rules for a search warrant are a combination of the state law and the individual judge's attitudes, I don't think there's enough for a search warrant. I've only heard of a tip leading to a search if the tipster was a known person who can either coroborate his story or has had previous truthful tips.

Presuming the J.W.'s are police, they could possibly be looking for plain sight items when they open the door- therefore leading to probable cause. If it were me, I'd just remove any illegal items and not answer the door for the J.w.. Put up a no soliciting sign, and file a police report if they continue to harrras you (the supposed j.w.). You really can't do anything about the cop, so close the curtains and keep the place clean.

Sorry, no firm advise.

Oh and no you usually don't have any way of determing if a warrant was issued. Usually they're sealed until execution (whether arrest or search) in my neck of the woods>

Anytime you are talking to someone who is in jail you should expect it to be taped. Doesn't mean they are taping but you will read/hear depending if it's in person or on the phone that they might be recording.

Actually I have known people who call and ask if there are any warrants on them. It's not unheard of. If you did have a warrant I don't think he'd be sitting outside for days on end. He would knock on the door, serve the warrant and arrest you.

Maybe he just thinks that you're the kind of person that may do something illegal, so your neighbors won't call and report the officer for being lazy and sitting on his ass all day, because they think he's watching you.

Not to be a smart ass, but if they had a warrant out for you, you'd probably know about it by now. Still, you may want to keep things cool for a while, ifyaknowwhatImean.

ok i didnt read the last 8 posts.. just wanted to say a few things.. first off.. by law they have to tell you if they are a cop or not.. and also, to find out if you have a warrant out for you, you need to call the local courthouse. Thats how my friends in the past have found out before they skipped town and left for california.

if they wanted you, they had you when you confronted the officer. instead of telling you to scram, he would probably start asking you questions trying to get you to admit something.

Nah undercover cops are about as sneaky as a cop in an unmarked car that has a license plate (ucp *3 numbers here*) ucp standing for under cover police.. and thats basically it. Undercover cops are just trying to bust you for traffic.. its undercover fbi agents you have to be worried about cause they dont have to tell you shit and are the ones coming after you for drugs.

how about you just call the dam cop shop and ask them why the hell a cop keeps parking outside your house at night.  If their is something is going on isn't it your right to know ?

but yah if that doesn't pan out, just start parking your car "exactly" where he likes to park
