ALBANY, N.Y. -- Salvia Divinorum. When ingested, it can cause hallucinations much like the effects of LSD. But there's a clear difference. If you're caught with it, police can't do a thing.

“Not a thing,” said Albany County Sheriff’s Department Inspector John Burke. “They could have a quantity, they could be selling it on the street, there's not a thing we could do with it.”

That's because Salvia is completely legal in New York State.

Burke frequents an underground website in his work, which states that Salvia can cause "dramatic, sometimes frightening, and completely enfolding entheogenic mind-states." Simply put, a user can feel like he's in a completely different place, different time, or that he's a different person altogether.

“If someone got behind the wheel of a car, they could have an accident, they could do all sorts of things. I don't know more people haven't looked at this drug,” Burke said. “You brought it actually to our attention. That's not to say someone wouldn't bring it in and sell it because if someone knows they can make money off of it they're going to sell it.”

We wanted to find out just how easy it is to get your hands on the drug, so we went to a shop on Lark Street. And in a few minutes, we had it in our hands. The bag says, “For incense use only.” But when the store clerk was asked if it could be smoked, he said, “Don't underestimate it just because it's legal."

And to underestimate it could be costly. The same clerk who sold it to us says he's heard numerous "horror stories" about bad trips. So many that he's been tempted to take it off his shelves altogether.

The drug is also sold all over the Internet. Some sites advertise potential medicinal effects. One site tells customers to get it soon while it still isn't banned.

Banning it is something the Senate has tried to do in this state for over two years after Senator John Flanagan of Long Island introduced a bill back in 2005. The bill passed twice in the Senate, but failed in the Assembly.

This year, the Senate passed it for a third time and it may be discussed in the Assembly's session next month.

i don't know anyone that sells salvia unless they have excess and want to give it to a friend.

Uhhh...correct me if I'm wrong, but I don't think someone under the influence of salvia is going to be physically ABLE to get behind the wheel of a car, much less put the keys in the ignition, back out of their parking spot, and drive down the road. The videos of people on it that I've seen entail them taking a hit and speaking gibberish, drooling, or making idiotic noises from the comfort of their beds or chairs.

if you took a hit of salvia 20x driving down the road you'd be absolutely fucked i'd agree with that. http://erowid.org/experiences/exp.php?ID=23194 here's a report of a guy who tried it on accident. Didn't go well.
