The state Court of Appeals today declared Tennessee’s tax on illegal drugs unconstitutional.
A three-judge panel of the court unanimously said that tax, enacted by the state Legislature three years ago, is “is arbitrary, capricious, and unreasonable and, therefore, invalid under the Tennessee Constitution.”
The ruling came in a lawsuit filed by lawyer Phil Lomonaco on behalf of Steve Waters. Lomonaco said Waters was arrested in 2005 after an undercover officer sold him about 1,000 grams of cocaine for $12,000.
A few days later, the state Department of Revenue sent him a bill for $55,316.84 in taxes and penalties under the “unauthorized substances tax.”
The tax requires people possessing illegal drugs to buy tax stamps, offered with an assurance the tax will be kept confidential. If later found in possession of untaxed drugs, a person can be sued for back taxes as well as facing criminal charges.
Today’s decision upheld a ruling by Loudon County Chancellor Frank V. Williams. The Department of Revenue has a right to appeal the Court of Appeals ruling to the state Supreme Court.

It is if you have the stamps, but they dont make the stamps. And in order to purchase a stamp one must posess the substance which you whish to purchase a stamp of. But to posess with out the stamp you are breaking the law.
Well, im not sure if they dont make any. I know they made a small amount of the marijuana tax stamps, but no one could buy them with out fucking themselves.
Its the most bullshit thing i have ever heard.
Why make it leagal when you can have so much fun fucking with peoples heads?

Nope. Do you have to write a letter before you can buy the stamp to mail it? Same idea. They sold the stamps to anybody that would give them money. Most of the stamps were purchased by stamp collectors rather than by drug dealers.

I live in Tn. It sucks here as far as the enforcement goes. They are real assholes. I'm moving ASAP.
I bet they taxed meth too, it's really bad in some places here. Another reason to move.
It's also hard to find weed that would be taxable. I don't think swagg fetches that much, and that's what we got. (Unless your a dumbass college kid that thinks that always getting drunk and living in a pigsty, and spending all your money on dank, yet having the largest beer pong table on the street, is what college is about. And these people are going to run our country?)

Yeah, I know its' out there. But its not here.
The only things I have access to, is pills, meth, and dirt weed.
I don't buy any of it. (I can get mids, but I have to drive an hour)

you fucks think you got it bad in tennesee??? lmfao! south carolina is the worst of the worst, the inventor of sled, the harborer of crack/meth addicts (both in 1!)
south carolina also invented the intervention program, the one where they say "ok here's your ticket, but can i search your car?" to everyone they pull over
this state is fucking ludicrous
it makes it so hard to find herb or any other drug my town is barren on everything, almost dirt-weed even now
no one will sell anything to a person they haven't known for years, because around here a new face is about a 80% chance that it's a narc or some ass that will get caught and rat you out
the cops here actually target the naive highschool stoners to scare them into ratting out the entire chain
