YOU BE THE JUDGE
The Neal Boortz Show has now placed you on the bench. You are a judge. A case has come to you on appeal. Nothing very exciting, just a little dispute over real estate. Here, as they say in legal circles, is how the case went down.
Jack Smith is suing Robert Brown. It?s a dispute over title to real state. Both Smith and Brown both claim title to about 100 acres. The trial court appoints a special master, a third party to review the claims and to suggest a solution. The special master decides that the best way to resolve the disputed claims would be to simply divide the real estate. Smith gets 50 acres. Brown gets 50 acres.
Smith thinks the decision is fair. He?s willing to accept his 50 acres and move in. Brown doesn?t like the decision at all. He rejects it. He decides he?s going to proceed with a legal action to attempt to get ALL of the property.
Brown wages a fierce battle in court. He files motion after motion and loses every one of them. Finally the court case concludes. It?s over. Smith, who had accepted the special master?s original offer, wins. Brown, who rejected the official offer and fought to get all of the land, loses. The land is now Smiths by virtue of his stunning victory at trial.
Now, after the case is over, after the decision has been rendered, Brown suddenly decides that he?ll go ahead and take the original offer. Smith says it?s too late. Brown had his chance and turned it down. He then fought in court and lost. It?s time for Brown to go away.
What is your decision?
It?s simple, my friends. Brown loses. He had his chance. He turned down a fair settlement. He wanted it all, or nothing. He so hated Smith that he didn?t even want him living on the adjacent property. Now Smith has it all.
Some of you have already caught on here, haven?t you. You know that this is all just an analogy. It?s is Smith and Brown at all. It?s Schlomo and Muhammad. It?s Israel and the so-called Palestinians.
The special master was the United Nations. The UN offered a partition plan. Israel accepted. The ?Palestinians? didn?t. The Arab world decided that it would fight ? not in court but in the hills and on the streets. Muhammad so hated Schlomo that he didn?t even want him in the neighborhood. Certainly it wouldn?t be too hard to push the Jews into the Mediterranean. Why accept the United Nation?s offer when with a few tanks, bullets and bombs you can have it all?
Oops. It seems we had just a wee bit of a miscalculation there. Schlomo was no pushover. As Muhammad was amassing his troops and armor on Schlomo?s border, Schlomo struck. It was no contest. Muhammad is pushed back. The law of conquest, the land is Schlomo?s.
It?s time for the world to work to protect Israel?s property rights. Let Muhammad and his angry crowd go confront Jordan. Wasn?t it Jordan that got fed up with Yassir Arafat and his Arab ?Palestinian? goons a few years back and slaughtered about 20,000 of them?
Truth is ? nobody in the Middle East wants Arafat and his hate-filled followers. The so-called ?Palestinians? are hated only slightly less than are the Jews. The only real friends they have are their allies in the ?hate-America? movement.

In 1947, the United Nations partitioned Palestine into two states, one for Palestinians and one for the recently massacred Jewish people. At the time, Zionism was seventy years old. The vote for partition occurred on November 29 and took no longer than three minutes, but for the faithful Zionist Dov Joseph, "it seemed to me to stretch the length of the Jewish exile."
When the results made it clear that a Jewish state would be carved out of Palestine, the public gallery erupted in cheers of jubilation. Joseph later wrote, "Men embraced each other sobbing with joy. The delegates streamed into the lobby, the galleries emptied, and the Jewish observers who were present were left to savor the sweet fulfillment of that moment of destiny."
That evening, the gallery of American Jewish and Zionist leaders left the UN headquarters in Flushing Meadows, NY to gather in the apartment of Nahum Goldman, head of the World Jewish Congress. They celebrated a great victory that night with Chaim Weizmain, one of the founding leaders of Zionism, a man who fought all his life for the creation of a Jewish state. He had been far too emotional to attend the actual vote, but he would not miss the party.
Gideon Rafael later recalled, "I remember him sitting there like on a throne, and everybody making their devotions to him. He sat there like a king, just happily smiling. It was a most unusual moment." The Jews, after centuries of persecution and six million lives lost in the Holocaust, had finally been granted a safe haven. But as the results were tallied, the Palestinian delegation sat stony faced, listening silently almost in disbelief. In three minutes time, they had just lost their homeland, one which they had inhabited since at least the seventh century AD. (There is evidence to suggest that Palestinians are descendents of the ancient Canaanites and Philistines; if that is the case, then they have inhabited that land for thirteen thousand years).
The UN partition plan allotted the Jews (an overwhelming majority of whom were recent immigrants) 55% of Palestine, despite the fact that they made up only one third of the population and owned only 6% of the land. The Jewish state was also to be given control over the two largest Palestinian cities, the important coastal towns of Haifa and Jaffa. While the Jews jubilantly accepted the partition plan, Palestinians flatly rejected it.
When David Ben Gurion declared the creation of the state of Israel, the surrounding Arab nations went to war with the Jewish state. According to the now conservative Israeli historian Benny Morris, that war, launched by the Arabs, was the "almost inevitable result" of a Zionist ideology that tried to create a non-Arab state on a land inhabited overwhelmingly by Arabs. Nearly 800,000 Palestinians were forced to leave their homes in the course of the 1948 war. Palestinians were massacred by Israeli forces in five hundred villages, of which 385 were completely razed to the ground.
Years later, Israeli Defense Minister Moshe Dyan would remind Jewish students of this history in a public speech: "Jewish villages were built in the place of Arab villages. You do not even know the names of these Arab villages, and I do not blame you because geography books no longer exist, not only do the books not exist, the Arab villages are not there either ... There is not one single place built in this country that did not have a former Arab population."
Years later, Israeli general and politician Yitzhak Rabin wrote in his memoirs about receiving an order from the highest echelons as a brigade commander in 1948 to expel the 50,000 Palestinians of Ramle and Lod from their homes. He calls it the hardest thing he has ever had to do in his life. Israel's military censor prevented that part from being published, explaining to Rabin that the state did not need one of its greatest generals writing about an organized ethnic cleansing of Palestinian refugees.
Journalist Seth Ackerman notes that according to an Israeli army intelligence report dated June 30, 1948, Israeli forces and Jewish paramilitaries were directly responsible for the mass expulsion of over half a million Palestinians in the 1948 war. After the cessation of hostilities, the United Nations Human Rights Commission declared that "Israel's grave breaches of the Geneva Convention relative to the protection of civilian persons in the time of war of 12 August, 1949, are war crimes and an affront against humanity."
According to notable Israeli historian Ilan Pappe, "Jews came and took, by means of uprooting and expulsion, a land that was Arab. We wanted to be a colonialist occupier, and yet to come across as moral at the same time."
After the 1948 war, the native Palestinian population found itself divided into three groups: the first group living as minorities on their own land under martial law with no say in the Jewish government ruling over them, the second living under Jordanian or Egyptian occupation in what was supposed to become independent Palestine, and the third living in miserable refugee camps scattered across the Middle East.
In March 1953, US Secretary of State John Foster Dulles visited Egyptian President Gamal Abdel Nasser to discuss the Arab-Israeli conflict, which at the time was only a few years old. Dulles pointed out to Nasser that the Jewish immigrants who had forced their way to Palestine from across the world were a Semitic people--just like the Arabs--and asked the Egyptian leader, "Isn't peace with Israel the natural thing?"
Nasser explained to Dulles that the Jews had come to Palestine from ninety different countries and that their Semitic origin, thousands of years old, was open to question (in reality, it is not). "Even if they are Semites," Nasser declared, "the [Israelis] came here as invaders and imposed on the Palestinians what they had learned from the Nazis."
Although the charge levied by Nasser was later carried forth by Holocaust survivor Israel Shahak and also by the son of Holocaust survivor Norman Finkelstein, it remains an egregious claim. Nasser's attitude is also representative of the intransigent position Arab states have taken to Israel since its inception. This intransigence has been based on one notion that Arab opponents of normalization with Israel have long argued: they insist that Israel is a colonial, expansionist state.

For thousand of years mr. Wright lived peacfuly in is home. Then one day the devil comes along, kills his family, and claims 5 of his 6 rooms. Now Mr. Wright can only stay in his bedroom or risk getting shot in the head. Mr. wright knows somthing must be done so he takes the devil to court, but the devil is a powerful person with friends in high places. The judge, whom is the devils buddy, decides that the devil deserve at least two thirds of the house. He grants him the master bedroom, master bathroom, the living room and the kitchen. Poor Mr. Wight is left with only the small bedroom and bathroom. Mr. wright cant even leave his house without the devils permission. Time goes by and the devil procedes to kill and detroy everything dear to Mr. Wright, and pretty soon Mr. Wright isnt even safe in is room anymore. The devil barges in, goes through all his stuff, and takes what he wants. The rage builds up in Mr. Wight. He askes himself why the devil gets to live in the house he worked so hard to build, and why the devil gets to treat him lilke an animal. He tryes to fight the devil, but the devil has weapons that Mr. Wright isnt even allowed to own, there is no chance, or is there. Mr. Wright finaly realizes his fate, the devil will not stop until he is completely destroyed, all the prayers and pleads cant help Mr. Wright, the devil is just to powerful. Mr. Wright must stop him, or his neighbors will be the devils next victim. If only the world knew the truth.
