defense dept today filed a scathing document (or something) basically saying that if the president declares someone an "enemy combatant" they do not have the right to legal counsel nor can the judicial system intervene on their behalf. additionally, the president can declare basically anyone he wants an "enemy combatant" and it will not be questioned.
does this not scare the SHIT out of you?? what basis does this have within the framework provided by the constitution??
without a doubt, i'm getting my degree and getting myself to canadia...

To be able to declare someone an enemy combatent for no reason is clearly wrong. If George starts declaring ramdom people that look at him funny enemy combatents then this will not be tolerated for long.
But, how about if the person is an enemy combatent in a foreign army fighting American boys? Well, the supreme court has ruled several times that the constitution prohibits automatic expatriation. That is , congress cannot provide for the involuntary loss of citizenship for somthing that he or she has done- for example commiting a crime, voting in a foreign election, or serving in the armed forces of another country.
This doesn't concern me though. The only way I'de ever fight in a war against America would be if we went to war with Israel, in which case I would fight on behalf of Israel and also publically renounce my citizenship.

Scary days indeed...although living in Canada wouldn't provide much protection either...if you are labelled as an "enemy combatant" The U.S. would petition to have you extradited back to the U.S....Scary days indeed...

Come on, don't be paranoid..this is for anti-terrorism! If this was ever misused, the Supreme Court would certainly have something to say about it.
Anyway if I'm wrong and I need to leave country, I'll be heading to Amsterdam instead of Canada!

I'm finding myself believe more of these types of things everyday. I'm not a conspiracy nut and don't believe about 75% of what some people say but this is scary. Does this remind you of a country a few decades back?

I just believe that the enemy combatant principles have been around for a very long time, they have been used before in other wars...this is not new, and it hasn't led to a collapse in our justice system before. In war, you don't bring back all your enemies and put them through your court system. That would be ridiculous.
Believe me, I would be the first to complain vehemently if I thought citizens were being treated this way just to get around the judicial system.
