 LEGAL ADVICE

Ok i need massive advice here. I was outside a dance club on friday night and i went around the corner to take a piss. My two friends and i were drinking in the car as we pulled up. As i came back around the corner to walk into the club a police officer was there in his car. He said hey kid come here. So went over and he said how many beers did u have tonight, i said 3. He said ok come here u have id? I gave him my id and he went over to the car where the girl was (my buddy that was driving had snuck into the club). The cop took the girls id and had us stand by the trunk. He walked away w/ our id's and im not sure exactly what he did w/ them. He came over and said where is ur buddy. I explained he was in the club and i called him. The cop said get him our here or im going in for im. He ended up going in for him as another cop pulled up. We were talking to the second cop for a bit explaining that we weren't bad kids and asking him questions... First cop comes out w/ my friend hands us back our id's and breath tests my friend. He blew a .19 and the cop took him in the cruiser and left. We were just there w/ the second cop and he wasn't 100% of what was happening but he said call for a ride. We were waiting for our ride and hes like u seem like good kids ill try to put in a good word. The ride came and we left. I was unsure and praying that i wouldnt' get introuble but i wasn't sure what would happen. So i called to police station and talked to a cop who asked me my info and pulled it up on the computer. He said that all it said was that i was seen staggering toward my friends car. He said it doesn't say anyting about writing an underage drinking to me but he also said that the cop may have written the jist down in a hurry. My buddy ended up getting a dui. I was thinking of calling wed. and asking for them to pull me up on the computer again to see if he added anything about me (like if i was getting an underage or not). I was wondering (cuz my dad would kill me being i just got in trouble) if i was going to get an underage or did the cop not even really care about us. Also maybe do i have a loophole to plea not guilty cuz he never breath tested me?
My stomach is in a fucking double ass knot.

I'm pretty sure the officer must write your citation, and hand it to you, at the time of the offense. You should be in the clear, but this is just an educated guess.
Another tip: use paragraphs.

I fail to see where you need advice on what to do. The situation has passed you seemed to get off lucky. Your friend did not. I agree with DNKYD on the citation at the time of the offense. The only thing I can tell you is hope we are right.

Ya i think i may remember one cop saying it would be on my permanent record cuz i was 18. The thing is i cant recall if it was the first cop who took my id or the second cop who just sorta showed up and didn't even know if i was gonna get in trouble.

They can bring up charges later, trust me. But on something weak like this, no way. Well at least they probably wont.

I'd like to think no it won't happen but then again cops will do sum messed up shit...I'd leave the police alone if I was you
like motherfuckin G said its quite possible late charges will be brought up but other then that I wouldn't worry

Ya i did say i had 3 beers though i dontk now if i put that in my story. More advice most appreciated. You said i should leave the cops alone? I was thinking like if i called and spoke to a dif. cop who would bring up my name on the computer it could tell me if i was golden or fucked? This would ease alot of my worries but is it a bad idea.

You got off-- leave it at that. You would have been aware of your charges already had you been busted.

Hey thanks man. Ya i think i may remember him saying i would get it in the mail. but like i said im not sure if that was the first cop or the second one who was just trying to anwser questions but didn't really konw what was gonna happen.Is that what u meant by me knowing if i was getting charges. Whatever happens i def. learned my lesson and ur right i am MAD scared. Yes i have a previous underage i got when i was 16. Im 18 now C/B

Wait wait wait, I still failing to see how your friend got a DUI if he was in the club, not driving. (Unless you mean he got charged with Dancing Under the Influence  ) Either way, the cops can come back and charge you later, I had it happen to me, but they need sufficient evidence, and it's the DA who looks at the evidence and decides yes or no. If they didn't find any alcohol on you, and they didn't Breathalyze you, then i doubt that the DA is going to be able to find enough evidence. I would just let sleeping dogs lie. Oh yeah, if you didn't get charged with anything, then there is nothing to go on your permanent record. Don't sweat it homie.

He drove there and got out of the car and i think a cop saw him walk/duck into the club. So the cop saw him drive up or like get out of driver or sumtin. Like i said i was pissing.

This is weird but a very similar thing just happened, to me, i wqas drunk in public cop came i got busted, called for a ride, got one, differance is my parents know but i was pretty drunk and i dont think he breathilized me, but i do remember lying down, next thing i know im leaning against a cop car, so i dont know if it happened sometime in there, but when he said, that i was drunk, he said you were staggering, not you testeda certain percent on a breathilizer. he said i wouuld get something in the mail in two to three weeks, its been like three weeks and four days, and im hoping they let it go, because he was talking about like P.O and court, shit scary stuff, just wondering if there was a case.
there so much more to this story, but its relative to punishment, o yeah a friend Quote unQoute got caught to and said the weed he had was mine, u think that evidence is circumstantial?
