WTF! I woke up this morning to 2 large men entering my room. They were the maintenance guys checking on all the fire extinguishers in my apartment complex. I was given NO notice of this and my state requires 48 hours notice before entry. I already called the front office; they lied and said I must have missed my notice, everyone received notices. I talked to many neighbors, and NONE had seen or received any notice. I am posting a "No Trespass" notice on my door, and will be moving out very soon. I am really pissed b/c I work for the same company that owns my apartment building, and was treated without respect when I called to complain. Can I file a lawsuit against the realty company for this (or the many code violations)? I know I can have someone arrested for illegal trespass, but I don't want to do that. This company rips me off for rent, took two weeks to fix our hot water w/o refund, and pays me shit. I have no reservations about filing my first my first lawsuit to get a point across about my civil liberties to an asshole owner who drives a new Mercedes every month.
Not a good way to wake up in the AM when I work night shift.

Move out and change the lock in your next apartment. If the landlord complains about the changed lock tell him he has no right to try to enter without notice.

Yup the first thing you always do when you move into a new apartment is change the locks. Don't know if the rental person or company has changed the locks the the previous renter used. Also changing locks prevents people from entering, at least without breaking down the door, your apartment or whatever.
If you look at your rental agreement you will see writing that says that the rental company can enter your apartment at anytime to check on things, like fire extinguishers et al. SO trying to file a lawsuit isn't going to help anything since you have agreed to such behavior when you signed your rental agreement.

Except in Emergencies! That pretty much covers up the "At Anytime" part. The management company can make up a reason and call it an emergency to enter at anytime.

The burden of proof is on them to demonstrate that there was an emergency or else they are in violation of the rental agreement.
I always put the little chain lock on so that they have to bust in if they really want to get in.

well if you work for them, or their subsidiary, do you really want to sue them?
and to be honest, there isnt much of a punative damage that you could get out of court .... as in reality.... there would be a very low cost assesed to the few minutes of time they were in your appartment....
had you been having sex on the coffee table, or meditating, or in some other way horribly disturbed you could sue for emotional damage, loss of fraternisation, or perhaps..... intentional infliction of emotional distress....
although you could perhaps sue for breach of contract... that might get you somthing... but probably not.

they cant fire you for for suing them, they'll find a reason a few months after the lawsuit though
My dog held a maintenance man in my apartment for about 6 hours, he was terrified, he pissed himself, she let him in the door, he did his work and she wouldnt let him leave, kept him pinned to the wall behind the door until I got home

I'm just about to sign a new lease agreement...an elderly couple owns the property(ies). The guy actually asked out of nowhere if I liked to go mushroom hunting.
I think this is an omen that I sign this lease.

I think he's more into morels...but I'm thinking about giving him and his wife some reishi or oysters or something...assuming the spawn substrate doesn't contam.
There's a nice park next to this place, and it's a great nature walk. The guy sort of has pelvic arthritis, as I saw it. I'm all about hanging out in the woods with fungal afficionadoes, tho.
That would be a bit fucked eating psychoactives with this elderly couple that are my landlords.

dude, life is too short to get so pissed off over something like this. I mean I see your point, if you had some grow-op going in plain sight, you wouldn't want people coming in and out of your apartment without notice.
But still--i wouldn't be starting law suits and moving over this. just my $0.02
