So, if I started a religion...

Okay... this is just me thinking. I am asking this question looking for a serious answer, but those of you that have read enough of my posts know not to take me too seriously. I'm not actually looking to start a religion, just asking a question...
*end pointless disclaimer*

So, let's say I started my own religion. And in this religion, we used Salvia in our ceremonies. Now let's say that the DEA finally decided to make Salvia an illegal substance, after my religion was already setup and practicing... Would the people in my religion still be free to use it? Would we be protected from the new law?

You'd be in trouble with the jack-booted thugs. The government doesn't care about religion unless it's in the mainstream. Ask some Branch Davidians...

I think how it works is, if the law making salvia illegal was challenged in court, it would win as long as They could prove that the law was not passed to discriminate against members of your religion.

There was a law in florida a while back making it illegal to slaughter livestock in a residence, but it was overturned because the law was written with the specific intent to stop Santaria practicioners from slaughtering animals in their religious ceremonies.

You do have a chance, but, I'll tell, you the peyote church people have a hard enough time holding on to their rights to use peyote, and they've had thir foot in the door of the courts since way back. (The peyote church predates America.) I'm pretty sure it would be even more difficult for a new religion.

Hey, I just thought of something. There's probably already a salvia religion. If you join that religion, you might have a fighting chance. You would need some kind of proof that you were a member prior to it being declared illegal.

If there is one, it's probably in Central America, or maybe South America.

Yes, the Mazetec Indians in Southern Mexico use Salvia in their religous practice.
They are mostly Catholic now and they call the plant Ska Maria Pastora which means 'leaves of Virgin Mary the sheperdess'.

They chew the leaves in complete darkness and silence.
The use of entheogenic plants is an essential part of their faith.

But of course in America, we don't stand for that kind of nonsense...

In the US it is very doubtful that you would be able to continue using salvia legally (given your scenario). Even the american indians that used peyote for thousands of years before there was a US have had a hard time. Freedom of religion gives you the right to believe anything you want, it does not give the religion the right to do anything it wants.

Think about a religion that is centered around human sacrifice. You can believe in it all you want, but if you go out and "kill a virgin" they are going to toss you in jail. Drugs in religion are viewed no differently.

Yup. Everyone cannot be satisfied at the same time in the same place, so we operate on the fringes. I bet if drugs were legal and accepted by everyone as sacrement, we'd be out there on the fringes of some other crazy shit; we're sort of the envelope pushers, the bleeding edge of society.

Rastah farians cannot practice legally. Neither can devil worshippers who sacrifice so I think they would arrest you.

the church of the tree of life declared everything not currently illegal to be a sacrament (as of 1971, in _the book of sacraments_) including pipinzptli (sp?) (which pretty much turned out to be S divinorum) ... and at least one more recent religion with diviner's sage had a website ... might be in the shroomery links section (or linkable from some of those sites, i dunno, hehheh...)

If your looking into starting your own religion, go to timothey learys home page and look around for something along the lines of: how to start your own religion. A very amusing read. It suggests that in the future(now) the country will be filled with psychedelic lawyers, who specilize in just this sort of thing.

If you want a case study of somebody that started a religion/cult, look into the Hubbard guy (? did I get the name correct?) that started up $cientology. Just be careful you don't get sucked into the cult and lose all your $$$ getting rid of alien karma.

yes this is true InI cant use Jah's herb in this country even tho we use it for religious reasons many a rasta have taken this to court but you know tha goverment its all screwed up
