they are not specifically scheduled substances so you are in un-charted waters in that regards.
get a good fucking lawyer that focuses on drug law, and you might have a chance.

If you've got a clean record, and they didn't find anything else on you, I'd say you've got a very good chance to walk away without any charge and a warning. If you've had drug charges before, they might choose to take it further.

I hope you didnt try and explain to them what the subsance was.
If you KEPT YOUR MOUTH SHUT (right to remain silent) then you have a much better chance of this shit being thrown out of court.
They will send the shit off to a lab to get tested .
As stated,this is still a grey legal area. Not sure of any cases setting precidence with this sort of arrest? May want to look into that, help your lawyer out a bit.
If you can, DO pay for a lawyer familiar with drug charges/cases.

BTW: did they pop you at the post office or were you pulled over speeding as said in that other thread? Did they seem to know what they were looking for or was it chance that they happened to harass and search you?

Right. Allot depends on the method of his bust.
If it was feds that were involved (ie: customs) then analogue act comes into play.

Keep the mouth shut indeed.
I know of two people who have been busted with exponentially larger amounts of RC's and gotten off fine. In neither situation were cops (or feds in one case) looking for that specific product though. It seems that catching them by surprise with the wrong drug can result in your favor... they did indeed get in a bit of shit for the much smaller (personal use amount) of the drug that was actually being sought out.
The term, "hits" sounds pretty bad though. Individual capsules?
Hope you're not in one of the areas that has had news reports of "New mysterious, dangerous LSD/E-like club drug 2C-I."

I think it's the 19th...
But that seems to be the last day for objections to be submitted. Real scheduling, officially will probably some time after. The tryptamine date was in october, and it doesn't seem they're officially scheduled yet.
But the point remains: Time is running thin, but at the moment they're still "illegal analogs" and not specifically listed schedule I drugs. While the analog act allows them to be treated as their scheduled counterparts, they generally aren't. (If they were treated identically, there would be no reason for this new scheduling).

PEA's will not be scheduled in December. They will not be put on an emergency list. There just hasn't been enough negative press for the DEA to make such an aggressive move, and it will ultimately hurt their attempts to make themselves more "needed".
It may happen by mid-year 2007.
