They are discussing this on the radio right now......
You and a good friend go out for beers. You have 7 beers your buddy has 8. He/She drives you home and for no fault of their own, end up hitting some ice or something and run into a utility pole.
Your friend has prior convictions, and this could screw up the rest of his or her life.
You have no priors.
Would you switch and take the blame?
Is it selfish not to?
So....what would you do?

I'd take a taxi.
But no, his priors are his responsibility. Not only that, but lying to police about who was driving is a good way to make sure you're both fucked.

If he/she has prior convictions, they should be smart enough to not drive after having 8 beers.
You should be smart enough to not get in the car with them in the 1st place.
You should both be smart enough to call a cab to go home.
I wouldn't take a DUI for someone with priors just because I had no record. If it was one of my best friends, and I had BEGGED them to drive home for some reason, and it was somehow my fault that they were in this predicament, I would consider it. But the way I see it is, you make the decision to drive drunk, and you should be willing to deal with e consequences.

Fuck a DUI, I wouldn't take it for him. My buddies and I have a system, if it's over two drinks, we find a DD or someone doesn't drink anymore. It's just makes sense with the alcohol related deaths on the road.

If he/she covered my legal fees and payed any applicable fine, then yes...I would take the DUI.
DUI's are fairly easy to beat in court if you have a good lawyer.

Any idea if the Canadian DUI process is different from the USA?
Around my parts they automatically take your DL for a year minimum, you must submit to random tests and a rehab program, plus your insurance goes through the roof.

Well, I guess I'm ol' skool about it then, cause in the described situation, yeah, I would take the charge for the other person. Of course, the other person would have to promptly bond me out, and provide a reasonable attorney for the proceedings.. but that would be my only requirement. Yea, I'd take the charge. Think about it.. ya homeboy would have to go up for a long time, and you, with no criminal history would get a little slap on the hand, first time DUI is a misdemeanor in my state.. I guess this thread shows how real some people are to their friends.

You know, I've spent a few nights sleeping in the back seat of my car after a night of heavy drinking.
Or, I've taken a taxi/public transit home, and picked up my car later.
There are very few reasons why someone should get behind the wheel of a car while intoxicated.
But meh, these days - I dont even have a lisence, I let it expire before I got my full one, don't have a car, and just about walk everywhere I would ever want to go

Nevada's DUI laws have changed a little, at least here in Reno. You get fucked pretty much no matter what if someone points a finger at you, even if you weren't driving. Happened to my buddy Jed.
I dunno about other places, but if you travel through Reno, and do some drinking, remember after 8pm, 3 out of every 5 people are under the influence Yay for casinos, lots and lots of casinos.

nope. I really need a car and its not like you can go to jail for DUI i think.
But what I would do is call up a buddy and have them come to the scene of the crime and then I would drive his car home and have him say he was driving my buddys car as a DD. Then I would drive home and no one would get a DUI and all would be well with the world.

I'd take it for them. DUI's are easy to beat in court. Most convictions are from self incrimination.
I'd sure as hell try and flee the scene first. It's not illegal to flee when your vehicle was the only one involved in the accident.

Well, in a situation very similar to the described one (Except multiply the drinks by a few ) I just dragged my buddy out of the car and made him leave and sober up and deal with it the next day. Saved either of us getting any charges, so what's that count as?

So....what would you do?
Ditch the car, run home, report that it was stolen earlier in the evening. You came out of the bar drunk (call someone to give you a ride there) and the car is gone.
After 8 beers, though, i don't know if I'd think past the "ditch the car" part.

Well, after being in the car with my best friend when he got a DUI, and living with him during it, I wouldnt. Tons of money, and loosing your license for a year.
After seeing that, I vowed NEVER to drink and drive...even if I had only a few beers.
So, I wouldnt be in that situation, but, I wouldn't take a DUI for a buddy. Id do a lot, but, not that !

Here in California, you only lose your license for three months, I think. You have to pay a huge fine and go to a class.

And no I wouldnt take the DUI for a friend mainly cause Ive already got a prior conviction myself... But had I never gotten the first, then yea I prolly would end up taking it for him.

I agree with what Liz said on the first page.
They chose to drive drunk, they chose to drive drunk WITH priors. It's their fault and they're going to deal with it.
I'd probably just walk away and get the car towed. Come back and get the car from the impound the next day. Whatever charge you get can't be as bad as a DUI.
