poll ..should the 4th amendment be revoked?...

the title of the thread might sound ludicrous to some (myself included)...however..a recent harris poll showed large majority support for unilateral surveillance (ie no legal requirement of probable cause that someone is a "suspected terrorist")...
while i strongly disagree with the majority..the poll results nevertheless raise the question of whether its time to render the legal issues irrelevant..and draft a constitutional amendment to give king george..and the people..what they want...as unpalatable as it is..IMNSHO its still better than a series of rubber stamps from the SCOTUS that have the same effect...
text of 4th amendment ..
Quote:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
EDIT ..the last item says "become a terrorist"..since "none of the above" goes against the majority...

> a recent harris (sic) poll showed large majority support for unilateral surveillance
Wow... we must have read a different Harris report... Nowhere did I see a poll asking people if they support unilateral surveillance.
Instead, I saw a poll that asked about four specific forms of surveillance:
* expanded camera surveillance on streets and in public places * closer monitoring of banking and credit card transactions * law enforcement monitoring of Internet chat rooms and other forums * monitoring of cell phones and email
Don't get me wrong, I have no love for the government chipping away at the constitution... but I also don't pull smoke from the air and pretend that it is something other than smoke.

How do you all think this will affect the discourse here at the Shroomery?

granted the word "unilateral" (meaning that no warrant nor court order is required) was not used in the poll...however..legal issues are being raised because king george has bypassed the court system..so the implication is still there...
theres no doubt that terrorist suspects should be kept under surveillance..but the question is who is a "terrorist suspect"...and in a civil society..only a court can be allowed to answer that question...

i think if a known terrorist is making phone calls to a house in the states the gov't should be able to tap into that phone call.
if someone purchases 5 billion pounds of amonium nitrate and fertilizer who has NOTHING to do with farming... and then that person makes a call to some random household I'd say YEA I think the gov't should tap that call.
I do believe they should need a warrant for that ability though.
I believe in the 4th amendment and it does say "against unreasonable searches and seizures"... notice how it says UNREASONABLE and not ALL. If darkadarka jihad mohammed in the middle east is a blatant terrorist and is known to be plotting something... and darakdarka jihad calls joe schmoe in the states... and joe schmoe buys a bunch of airline tickets.. I don't think it's unreasonable to want to tap his phone calls, do you?
I don't know what kind of calls the NSA is tapping. If they're frivilously tapping calls the way the gov't was accusing people of being communists back in the day, this is unjust... but for all we know... all the calls that have been tapped have been for good reason and may have prevented your OWN FAMILY from being killed... it's quite possible
Who really knows?
