Do you think that American law should reflect the possibility that two men would want to call each other out for a mutually agreed upon duel, and that the law would not punish the "winner" for any sort of crime? I personally support the concept of dueling. Two people, not hurting anyone else, none of my business.

Dueling is still legal in at least one part of America. I went on a tour somewhere in georgia or south carolina and i was told that.

I think dueling should be legal but regulated. The duelers should be required to buy some "dueling insurance" that would cover any medical or funeral costs. I think there should also be a waiting period, so the participants have time to think it over before going through with it. And perhaps there should be a mandatory psychiatric evaluation for the participants. If we had official guidelines like this, I'd be fine with it. However, if it went unregulated, then anyone who shot another guy could just claim that they were dueling.

I'm against too much government regulation in this. I don't think that the government should ever have "Veto power" in this situation.

Well, if the duelers don't have insurance, then that means the taxpayers have to foot their bill. At the very least, the government should step in to prevent that from happening.

How?

If the duelers duel "illegally", should they prosecute the guy for murder just because the loser didn't have insurance?

I just don't see what the government can do to really "prevent" dueling, if they do decide to make it legal in some instances.

As I said before, anyone can shoot a guy and then claim it was in a duel. Duels would need to be official in order to prevent such abuses. As for the insurance thing, I need to point out that not all duels end in death. Those who survive will need medical treatment, and if they don't have insurance, then the taxpayers have to pay for the costs.

Incorrect. In the ideal government, we wouldn't have socialistic policies of "heal the man, and charge the group". If the guy couldn't afford medical care and he couldn't get it from a charity hospital, well, when you enter a duel with guns, you gotta accept that death can occur.

A duel should be somewhat like a "marriage". Go to the judge, fill out some paperwork, prove that you are who you say you are, maybe even wait two days, then the rest is up to the duelers.

A duel with guns obviously wouldn't occur in Times Square. I'm sure that the loser would have someone willing to take care of him. Since you seem to think that people would be so supportive of paying for it that they'd let the government steal their money, why not just ask some of them for voluntary donations?

True enough, I guess if both parties agreed. I don't see why 2 people would ever agree to such a barbaric and dangerous act. Even if I was the best shot in the world, I would not do this. I wouldn't want to kill someone either, unless I had to. That's just my opinion, if two people wanted to do this, for what ever reasons, I say fine.

Federal law > state law

So it doesn't matter what states pass any city or state cop can arrest a person for a federal offense. Also vice versa.
