sorry guys i didn't get in to nyc until late last night and then all day at work has been very hectic.
i'm going to just cut and paste the email i sent out to all of our close friends & family giving you the status of things.
thank you all SOOOO very much for thinking of yos yesterday, even though things didn't go as good as we had hoped, i'm sure all the positive energy helped in little ways and in the end all of this will work out!

dear friends & family, i wish this email subject read "yos is home!" or "all the false charges were dismissed" - but unfortunately i can write neither. i returned last night from my 17 hour stint in pennsylvania with very little changed from the day before. here are the details: *all 4 guys involved were offered a blanket deal of 1-2 years in state prison *all of the federal charges were dropped - the DEA didn't feel that there was a strong enough case for the drug racketeering charges *george did admit that all drugs & most of the cash found in the hotel room were in his possession [the remainder of the cash - about 15K - belonged to 'j'] *george and harris both took the 1-2 year deal, even though harris had NOTHING on him. his public defender advised that he take the deal, my guess was because he didn't want to see this through to trial. george totally lucked out - we were all thinking he was going to get 5+ years *yos, myself and yos's lawyer [mr. davis] all thought that yos should not take the deal, so he turned it down *the other guy involved, j, also turned down the deal *when the hearing finally started, the d.a. immediately asked for a continuance as the lab results from the substances found at the crime scene have yet to be completed. this continuance was granted and the new hearing date has been set for september 27 at 10:45am *both mr. davis and 'j's' lawyer asked for a reduction in bail/bond. because both 'j' and yos are from out of state, the judge reduced it from 200K straight cash to 100K straight cash - still completely unattainable for me at this point *mr. davis is going to work on filing a petition with another judge to get yos's bail reduced further prior to the first hearing so he doesn't have to spend any more time in fayette county *if he chooses not to file a petition [because he can't find a judge that will grant the reduction in bond] than we must wait until sept 27 at which point judge george has promised to reduce it to a lesser amount and allow a percentage [rather than straight cash] *the deal that was extended to yos [and all of the co-defendants] will not change, meaning we will be taking this case to trial unless mr. davis feels that he can't show that 3 of the 5 charges against yos are false. if mr. davis feels that after seeing the evidence the d.a. has against yos in the discovery portion of the first hearing that he can't win the case, yos will then take the plea [if it's still on the table at that point]. *currently yos is charged with 3 misdemeanors [possession, paraphernalia & something i can't remember] and 2 felonies [conspiracy & intent to distribute] - none federal, all state charges *both george & harris have said to mr. davis in front of their attorneys that they will testify at yos's trial that he not only was not involved with the drugs and money found in the hotel room but that he wasn't selling any drugs on his own. right now our biggest concerns are beating the 2 felonies, and if we can break the conspiracy charge, that should make the intent to distribute fall away as well. and with the help of their testimonies, we should be able to do that. *'j's family has bonded him out [they put up their house i believe] and 10K [which they will never get back]. *george & harris are at fayette county still awaiting their sentencing
yos looks fine, he has enough food and appreciates all of the letters he has received - keep 'em coming! please PM me for his address if you wish to write! thank you ALL for your love and support throughout all of this. unfortunately things did not go as well as we had hoped, but they didn't turn out terrible, and for that i am grateful. please keep us in your hearts & minds. much love, moira

Hopefully the D.A. will drop the felonies once they realize that the other two guys will testify to exonerate Yos.

I have had friends. best friends that did 2 years in prison and 3 years in jail for prescription drug forgery, yea it would suck but i bar3ly have money to get by. I feel sorry, but I dont know the guy..

that's not bad at all. he's lucky the guys are willing to help him out. like i always say, the truth always comes out in the end.
however, he could still get charged with conspiracy because it is highly unlikely that he knew nothing of what was going on, even if he wasn't actively participating in it.
what i'm saying is, judging by the amount of shit they got rolled with, it would be hard for him to not have noticed any of it.
