Should I bring this citation to court?
    #5842895 - 07/10/06 03:25 PM (17 years, 6 months ago)

I got a 75$ fine that I can't really afford, for not coming to a complete stop at a red light before turning right (it was from a traffic camera). I really don't want to pay this because I can't really afford it, but if I bring it to court and they make me pay, I'll have to pay $100 instead of 75.

I don't have much of a case...do you think I'd have a chance bringing it to court and apologizing to the judge and that sort of thing?

Did they send a picture? Go ahead and contest it if you can't be seen in the picture. Give a friend a joint to say they were driving that day... they won't get in trouble (because the charge wasn't for them) and yours will be dropped.

fight it, the worse thing that can happen is that they charge you anyways.

oh and as a bosster of faith. in chicago 86% of all tickets brought to court and contested were dismissed (parking tickets that is)

depends on if the cop shows up or not. In a lot of cases if the ticketing officer shows up it's his word against yours and the judges usually tend to side with the cops.

No harm in fighting it tho, i never pay moving violations without fighting it as usually you have the ticket reduced substantially.

Yeah, it's a camera though, so no cops involved.

ah, you're screwed then man. Photo's are damn solid evidence in cases, the only way you might be able to get away with it is if it didn't correctly capture your plates.

They have to prove you were the driver.

no they don't, your car your ticket regardless of who's driving it. If you lend your buddy your car and he gets busted buying drugs in the street and the cops take your car, say goodbye to it because even though you werent the driver it's still your responsibility.

They aren't ticketing the car they are ticketing the driver. They have to prove he's the driver.

Your example is unrelated.

nah man, they don't have to prove anything. Your car your problem. The cam shows the license plate number, color, and if its good enough the make and model. In cases like these where they use a camera they ticket the car.

One of the cities around my place has a camera set up for people running red lights. They dont even need to know whos driving the car. All they do is snap a shot of plate #'s and send ya the ticket in the mail. I've never heard of anybody's case being thrown out either.

So you might as well just pay the $75. This is where you have to think would you rather pay $75 or would you rather pay $100 if you dont win? Chances are you wont win either.

they dont have to prove you were driving, if you dont know who you are lending your car to they dont care like people were saying its your responsibility... if someone actually was driving it then you could get them to take the blame but that means they have to pay the 75, its not like its dismissed if someone else is driving...

your only arguement is that the camera cant tell if a car stops or not, and that you did stop but the camera recognized a car going through a red light so it took a picture...
