Losing a Deposit
    #5803525 - 06/29/06 02:49 PM (17 years, 7 months ago)

So my roommates and I are moving out of our old apartment, which we trashed fairly thoroughly (tons of burn holes in carpet, some vaguely fist-shaped holes in cabinet). I was wondering if they can demand more money from us than the security deposit...or does that the maximum they can deduct from us? I'm kind of worried as I'm living on a shoestring right now and can't afford these expenses.

They'll probably have to sue you to get more than your security deposit, but check your lease and talk to a lawyer to get more information.

Interesting fact about deposits: Here in Calif. IDK about other states, but..
If you put a deposit down on real estate( ie: house, apt.) the landlord must put entire deposit into an interest-earning account! This accrued interest belongs to the renter, and must be paid to him at the end of the lease. Also, the landlord has limited time to claim damages. Check into your states particular laws. A little off topic, but my .02
Peace

Yea my last apartment sued us and kept the deposit. Ended up paying 3000 grand for a new carpet and i think stove/oven.

They didnt quite like the hair dye stains in the bathroom, the burnt cig marks on the carpet and the fact that someone broke the oven.

Note to self: find cleaner roommate

Dude, I have rabbits also and those furballs made a couple meals out of the carpet. The apt manager kept like $75 of my deposit to repair it. Oh well.

If you think the damages might exceed the deposit, you might want to try to repair some stuff yourself. Like fix holes in the drywall and new cabinet doors and stuff.
