Hey, I was just wondering if not having insurance allows a cop to search your car without a warent?

Yes. If you have broken a serious motor vehicle law, I believe they can search your car.

But whether I'm right or wrong, one thing I can definately tell you is that you should NEVER have any illegal items in a car that isn't 100% legal, including the car, driver, and all occupants.

Oh and make sure your freakin insurance sticker is on the back licence plate. I had a cop yell out his window at me once about that very thing, while also making a u-turn onto busy highway and chasing down a stolen car. What he didnt know is that I had the stolen car and he was chasing down some old lady that just drove like a mad-... woman.

Also, I do believe "not have insurance" accounts for a serious law being broken.

Until somebody without insurance totals your car in an accident, then their lack of insurance is a pretty serious issue. Especially if their insurance would have paid for your medical bills that were caused by their careless actions.

not having insurance in states where it's manditory is a jailing offense but like
all crimes, arrest is at the officers discression. When you're arrested the
officer is allowed to 'inventory' your vehicle, anything found can be used as
evidence against you, not having insurance, in it's self is not probable cause
for a search but refusal can certainly warrant an arrest and inventory.

Not in all states. Some places it's just a ticket. The thing is that they can't really tell if you have insurance or not, what they do is write a ticket for "no proof of insurance". So if you have insurance, but just didn't have the card you can mail a copy in and they cancel the ticket. So if you admit that you have no insurance they might arrest you or prevent you from driving away in your car, but if you tell them you have insurance then they just cite you for no proof, which is not nearly as bad.

im with fastfred here.

I have lived in many US states, and every time i havent had an insurance card, i was given a ticket to provide proof. Fax a copy to the court, and im home free.

The only time I recieved a real ticket was not being able to provide proof of insurance in an accident...but i was insured..just without my card.

I dont think the cop has a right to search your car. But it depends on where you live

You can go 90 days without insurance in NY... but it costs you $8 per day for NYS' insurance... which you have to pay or else they suspend your license...

again, thats a call on officers discretion as I mentioned in the earlier post,
as for not knowing, maybe your stat hasnt implemented the database yet but
they have in more than a dozen already, let your insurance lapse and its
immediately updated in the DMV records, thy run your tag and they know, down
here you still need proof of insurance to get tags but they verify the info
through the database

no they can't search your car for a traffic/motor vehicle offense.Like someone else said,if they arrest you they can inventory your car and may find something,but even then if whatever item they find isn't in plain site,then you can say you had no idea it was there,and as long as your prints aren't on it they can't prove you knowingly had possession,which is what they have to prove.NEVER ADMIT POSSESSION.The reason they can't search your car is because just because you don't have insurance doesn't mean your a drug user,or carrier.In order for a cop to search your car legally they have to had been able to see something that would make them think that drugs are in the car.They can't even say that they smelled pot to legally search your car,or at least that's how the judge ruled in my case.That was back in 2000 though,before the Patriot Act.

When you get right down to it, the cops can do whatever they please when they pull you over for a traffic offense, legal or not. A cop would much rather bend the law and perform an illegal search in order to find contraband allowing him to make an arrest and let the courts sort it all out than to let you go if he suspects you might have something. He knows that he is not going to get in trouble if he doesn't find anything, and there is a very good chance that the illegal search will still be allowed in court.

In Virginia you are allowed to drive a vehicle without insurance if you pay a one time $500 Uninsured Motorist Fee at the DMV while registering your vehicle.

One of my friends drives around without insurance unfortunately. He lost it when he plowed his truck head first into a tree at 30mph with me as the passenger.

$500 is a lot to pay for nothing, but unfortunately there wasn't an Insurance company he could find that would touch him for under $5k a year.

Here in TN, it's just a ticket, which you can usually get dropped if you provide proof of insurance in court.

The passengers are safe tho, in most states cops can't just ask to see your idea, its against the law. Atleast here in NC.
