(AP) SAN FRANCISCO A federal appeals court in San Francisco today dismissed a lawsuit in which a former deputy U.S. marshal claimed he was drugged with LSD by a CIA agent during a Christmas party in 1957.
Former Deputy Marshal Wayne Ritchie, now 79, claimed the alleged secret drugging at a holiday party at a federal courthouse in San Francisco was part of the CIA's experiments with mind control during the Cold War era.
He charged that the alleged drugging was the reason why he tried to rob a Fillmore Street bar in San Francisco after leaving the party on December 20, 1957.
Ritchie did not file his lawsuit until 2000, after he had read about CIA experimentation with unwitting subjects in the 1950s.
A three-judge panel of the 9th U.S. Circuit Court of Appeals upheld the dismissal of the lawsuit by U.S. District Judge Marilyn Patel in San Francisco last year.
The court agreed with Patel's conclusion, reached after a four-day non-jury trial in Patel's court, that Ritchie hadn't proved that any government agents slipped the drug into his drinks or that the robbery was the result of an LSD-induced psychotic disorder.
Patel said that other causes such as mild intoxication from several bourbon drinks and some organic factor may have explained Ritchie’s conduct.
Ritchie was captured during the attempted robbery of the bar, pleaded guilty to attempted armed robbery, was sentenced to probation and resigned from his job.
Appeals court Judge Alex Kozinski wrote in a footnote that the case was a "troubling" one and noted that Ritchie had spent years trying to clear his name.
Kozinski noted that the government has admitted that some people were drugged during the Cold War era. He wrote that although Ritchie hadn’t proved it, "we think it is quite possible that everything Ritchie says happened did happen - that he was drugged by his own government and suffered great personal and financial hardship as a result.
Kozinski said in the footnote, "If Ritchie's claims are indeed true, he has paid a terrible price in the name of national security."
