Deputy's traffic stop in Deerfield results in Ecstasy arrest June 9, 2006 - Sun Sentinel
DEERFIELD BEACH -- A man pulled over for a traffic violation ended up in jail on drug charges Thursday after Broward sheriff's deputies found more than 400 grams of Ecstasy in his truck, authorities said.
Sergio Reyes Lopez, 36, of Hialeah, was southbound on Interstate 95 near Hillsboro Boulevard about 1:45 a.m. when a deputy saw him a driving behind another vehicle too closely, an arrest report said.
The deputy stopped him, and a police dog indicated that drugs might be in Lopez's semitrailer truck, the report said. Deputies searched the vehicle and found the ecstasy, according to the report.
Lopez was being held in the Broward County Main Jail Thursday on charges of trafficking in MDMA, the active ingredient in Ecstasy, over 400 grams and following a vehicle too closely. Bail was set at $500,000.

How were they allowed to bring a drug dog up to his car for just a minor traffic violation? He should be off with a good lawyer...

The Supreme Court ruled that a dog sniff can be used during any traffic stop, regardless of probable cause

I recently made a comment in another thread about large amounts of MDMA in the trunks of cars having a strange tendancy to cause people to drive like idiots.
This guy was just driving too closely, though. And a drug dog was obviously needed to investigate that. I have a feeling that the alleged traffic violations are usually fabricated, and it's just plain profiling. Probably race usually. Or maybe this guy had neon pink brake lights, and glow sticks in his mouth.

they are only allowed to do a warrantless, probablecauseless search if the amount of time it takes is less than that it would generally take for a routine traffic stop.
i.e. they cant give you an un-due delay

yeah thats actually how i got off one of my charges.. i was pulled over for speeding and a local smokey made me sit outside on the curb, handcuffed for 30 mins while they got a dog out to my car.. even my public defender was able to get all charges dismissed

I was pulled over before a festival for "following too closely" in Florida aswell. I was definetly not too close, but he told me he needed room enough for 2 cop cars to pass me and pull the guy over in front of me, so they just pulled me over instead. THANK GOD I didn't get searched even though they threatened to search me and bring a dog down - nothing came of it. Just be smart and respectful and usually you will be alright.
I have a feeling that dogs are trained to bark anyway on command. Has anyone ever had a dog come and they NOT bark?! Even in a clean car?

I've had a dog "indicate" me before when I didn't have drugs. I can personally vouch for dogs being BS.
In high school they would bring dogs through and search like once a year. I used to carry around a bag every where I went, I never thought the administration would peg me as a dealer for it *shrug*. When the dog came through it passed four people in my class who had fat sacks and supposedly indicated drugs in my bag.
So the cop and the Principle pull me out and cop says in a arrogant demeaning tone "Why is my dog so interested in your bag son" Now normally I play nice but I didn't have anything and I never carried anything to school for just this reason, so my reply..."Cause your dog has a fetish for gym cloths, how the hell should I know its your dog"
Cop get kinda pissed smiles and goes "Mind if we search your bag?"
I say "Why you got the same fetish?" for some reason this leaves the cop speechless. Since I was in the middle of an exam I shrug and so "Knock yourself out, hey if u find my pencil let me know" the humor was completely lost on this officer *shrug*
After searching my bag the cop throws all thus stuff at me in a pile and says in a surprised voice "Nothin there"
Which for me was yet another invitation to point out the idiocy of this situation. "Of course there isn't, but I'm sure my parents will be overjoyed to find that their tax dollars are going to fund a bogus drug dog program. A program who's only accomplishment today was to keep their son from completing his midterm on time. They'd be even more happy if I failed this geometry exam so that a cop can get his jollies fondling my jock strap."
The cop made some smartass reply about how he could make things harder on me, can't remember the exact words but my reply was "Yes you could continue to interrogate and person under the age of 18 without a parent present, but then that might get you in a bit of trouble now wouldn't it." I gave him the biggest shit eating grin I could and started back to class.

Sorta, You can pay all of your bail and if u show up to court you get all of it back. Or you can pay 10-20 percent to a bondsman and they will post your whole bail but you never see that money again.

in hs a friend had 2 joints in his bag that u might have been able to smell if u put your own face up the bag and the dogs had no clue...they started barking at some pc lol

Once when I was in the ARMY, we had a surprise barracks inspection, in which they were looking for drugs. A couple of my friends who roomed together had a dirty bong out of which they had very recently smoked hidden in there room. They wrapped it up in a old oily rag just before the CID came through.
Well, the dog went in and sniffed all over and left without alerting to anything. As soon as they were gone one of my friends sat down on the couch with a big sigh of relief and let his hands drop down onto the couch. One hand kind of went in between the cushions where he felt a familiar object. He pulled it out and was hold a joint that he'd rolled a few nights earlier and had lost.
That dog must have been the worst drug sniffing dog ever.

Yeah. They like to think of drug dogs as standardized and completely reliable. Taken more seriously in court than lie detector machines. But, no matter how well they test in controlled training exercises, they'll differ in the field.
