So, I just moved in to my new home. I'm living with 3 college students who needed another housemate. We haven't had massive parties or anything, at most we've had possible 4 people over besides ourselves.
Anyhoo, within 2 days of moving in, the police were at our door for a noise violation. I accepted that one, got a verbal warning, and went back inside. I went out of my way to be curteous, and respectful of the officers.

Well, last night there were 3 people home, and we were sitting in my lounge watching the history channel. Suddenly we hear a slam on the door. Then another and another. I run downstairs, and I see red and blue lights. Great, cops again.

So, I open the door, shut it right behind me, and immediately the cop started laying into me. First off, he asked why it took so long to open the door. I said that I asked the other housemates to let me handle police situations since I'm the oldest, and because I'm a law student so I understand my rights a bit more than your average person.

Well, the cop says that we had another noise violation, and starts arguing with me about how we were obviously being noisey or else the neighbors wouldn't have complained. I stated that there were 3 people in the house, and we were all upstairs watching tv. The cop then told me I was lying because "the neighbors would never lie." So, I told the cop that if he already knew the answers, then it was pointless to question me, I have nothing to say to him, and I asked if I could go back inside my house. He then gave me a speech about the "real world" which made me want to tear his damn throat out. More on that later.

So, the cop takes down my name and number, and then starts saying that he's going to get in touch with the college and see if they can have us moved to a new house (I think he thought the house was owned by the college and not us). I think it was posturing.

First off, I was extremely put off by how the officer acted. I don't appreciate being called a liar on the front porch of my house, by a cop who wasn't even invited on to said porch. Second off, I don't appreciate a cop accusing me of something for which there is no proof. The house was completely dark, and the only people were upstairs watching tv quietly. Thirdly, I don't appreciate that I can't even watch tv in my own house without a pig showing up at my door. Finally, I don't appreciate being chided, told I'm a liar and don't know how the "real world" is by a cop when I'm trying to explain this to him.

So, I got the officer's name and badge number, and I'm considering issuing a complaint. Is it even worth it? Will this just make my situation worse? Its bad enough that the cops have come twice in 2 weeks and I'm beginning to feel very unsafe in my own home, but to have the cops that do come act extremely unprofessional, and attempt to insult me on my own porch, I take great offense to that. Especially when I wasn't doing anything wrong. Maybe this post is just to vent also, but really, ugh. I'm so pissed.

As an aside, never tell a young person that they don't know what the real world is, because you have no idea what sort of shoes they're in. I have 2 dead parents, and I pay all of my own bills, rent, and college tuition. I work 13 hours a day, more than any damn pig works. So when I hear someone say that to me, it instantly pisses me off.

Wow.... Sorry to read about your situation.

Any way the neighbors have something againse you or your roomies, and are just fucking with you/them?

Maybe lodge a complaint against the officer?

The neighbors have openly stated that they're not comfortable living with college students next door. So, to try and rectify this I've been shaping the garden in front and in back of the house, I've done everything I can to be cordial, but someone keeps calling the police.

I'm thinking the only thing that's saving us from a citation is the fact that each time the police have showed up there's no music, and only a few people in the house, so they obviously have no evidence that we were in fact being noisy. We specifically keep people either in the lounge in the attic, or in the basement which is insulated so no sound gets out. I just wish they'd stop showing up since they're not going to catch us doing anything.

Damn...

Yea, in my experience if a neighbor gets a bug up there arse about some young kids living by them, they will actually go out of their way to try and get them into police trouble.

Can be a tough situation to rectify.

Bogus. I would file a complaint. Your story got my blood hot. You guys were not being loud and his rudeness was uncalled for. But, if you're doing anything illegal you may want to consider the possibility of them getting a warrant for a search on some total BS, just to get back at you. Cops have power and are just waiting to abuse it.

Is there any action you can take against the neighbor? If they do it again, I'd certainly look into it. This is harassment, you're not even able to *live*, let alone enjoy yourself in your place of residence.

There's not a doubt in my mind that the crabby old man or woman responsible has done this to previous neighbors at some point. I'm sure they have a record of unreasonable complaints. I've known a few of these people in my day.

Thanks guys! I'm wondering if there's anything the police can even do if they show up for a house that's had a complaint lodged against it, and its pretty obvious that the house isn't noisey. I mean, this is getting pretty bad. Its even worse when I try to ask the officer questions and he just deflects everything.

Be ready for a search until this issue has resolved itself..you never know which direction things might go.
Document everything!! Time, Place, who showed up, what was said. If it isn't written down, it didn't happen.
Ask for a copy of the formal complaint. This will have the complainant's info on it.
If no formal complaint has been filed, state to officers that you believe you are being harrassed, and until a copy of said complaint has been provided to you, any further action taken by police or any other party concerning this matter will be treated as such.
And then say, " GOOD DAY, SIR!!"...." I SAID GOOD DAY!!"

It sounds to me like an issue with the neighbor more than an issue with the cop.

You can go the easy route and talk to the neighbors. Tell them that you appreciate the situation and would prefer them to let you know directly, rather than calling the police, if things get too loud. If they feel they are in control of the situtation, it may help calm them down and prevent futher escalation of the problem.

However, if you really want to fight this, I would prepare for it the same way I would prepare for a war. It is going to be a long battle, so make sure you have what it takes to stick to it...

Start by researching the laws that pertain to the situtation. What constitutes a noise violation? What else can they use against you. What can you use against them? Is their garage extension legal? Is that old junked car in the back against city code? Two can play at the "mean neighbor" game.

Do not alienate the police with a report against the officer. Instead, use the police to your advantage. Find out when the officer that was at your house is "at his desk". Go to the station and visit with him. Let him know that you talked with the neighbors and left your number so they could contact you directly rather than bothering the police when they have an issue. Let it be known that the neighbors have a grudge aganist you and that they are wasting the cops time. You are the good guy with a goal of being a prosecutor some day. You know how hard the cops work and that you will do anything you can to help in this situation.

If you get in a pissing match with the police, the police will win. If you can get your neighbor into a pissing match with the police... well, then you win. In the "real world" it is all about politics... who can out play who... sometimes you gotta swallow your pride and loose the battle in order to win the war. (I used to hate hearing people talk about the "real world" too.)

damn, thats a shitty situation. how is your parking? do you have tons of cars out on the road? that can really piss people off sometimes, and we've almost gotten fucked several times because of it.

last time they came, we were smoking a blunt when he knocked on the door. it took us more than a full minute to answer it, and my buddy flushed 2 ounces of good weed. the cop said my truck had to be moved whenever the guy who owns the house went outside, and when i went out there he just started yellin about how he could smell the pot and could take us all to jail and blah blah blah.

it was funny though, he kept trying to get me to admit to being high and having weed and i just didn't answer him. gave him a stone cold glare, eyeball to eyeball and didn't blink. i figured anything i said would be something he could use against me. it really pissed him off but after a second he told me to move my truck and he sat there and watched me do it. i figured he was gonna try to give me a DUI, but he left after i moved.

later we found out they thought we were selling meth out of the house. anyways, i would try to resolve it with the neighbors peacefully, some people are just dicks though. suess gave good advice, you won't beat the system, but you can play it to your advantage. good luck

Really good point about the parking. Many old people hate not being allowed to park directly in front of their houses. Some go as far as to bitching if they don't get the passenger side door lined up with the sidewalk, etc. If that's the case (and these are indeed old people we're dealing with?) inform them that if they want the right to a parking spot in front of their house because they're old and fragile, they probably have the right to request a handicapped spot.

As far as dealing with them directly goes, these people don't want to deal with you, that's why they aren't. They could very well just be afraid of dealing with people your age. They're obviously prejudiced against college age people. Approach very cautiously, be non-aggressive (though not passive) as hell. If one of the people in your house is a girl, they might seem less of a threat.

Be expected for the possibility that they don't even answer the door, and the cops show up because of a 'tresspassing' report. Prepare for war indeed. Play by the rules, and don't have anything suspect in your house.
