You better pray, because the vet ain't gonna win. He's complaining about footage that was already in the public domain (Moore used a clip from Nightly News). He has no chance of getting a penny from Moore. If stumpy didn't want to be featured elsewhere, he shouldn't have gave an interview for Nightly News to begin with.

Please point out the exception in law that allows media in the public domain to be used freely for libel..or are you just making this up?

do you want the vet to win because you dislike moore and his films...or do you actually think this lawsuit has merit? If you want the vet to win only because you disagree with Moore, well then, that's stupid.

I dont think the lawsuit will go far. I doubt the subject of an interview has rights over a piece - the owners of the piece do (NBC). And I'm sure Miramax cleared the interview with NBC allowing Moore to edit the piece has he sees fit. I am willing to bet that when someone agrees to be interviewed by someone like NBC, they also agree to waive their rights.

Looks like the vet and his lawyer are attempting to cash in.

There is never, never an excuse for supporting a frivolous lawsuit.

That veteran is just being opportunistic. His appearance in the film did not cause him damages. He just wants to be able to live a wealthy, selfish retirement paid for by the mistake of another person.

Whether or not michael moore is a douchebag, the veteran is certainly acting like one.

I hope Moore loses, but I also hope that he loses justly. As much as I despise the hair covered lardball, I don't wnat someone to railroad him just because a disabled vet is sueing.

I think anyone that takes video of you, and uses it out of context, against that individuals own beliefs should be put to death. In this case, Michael Moore should be executed IMO.

I am a fan of free speech, but IMO this oversteps the boundary. Its using other's speech freely, and frankly, it's libel.

1) libel refers to written things.
2) slander refers to someone saying something.

It isn't either, nor is it even Defamation of character, because it is not a lie, it is actual footage of this guy talking, even if portrayed with a slant or edited in such a way.

emotional distress is very difficult to prove, especially being able to prove that one thing is the sole cause of it all.

and "loss of reputation"? I think this guys reputation now is a whining douchebag, which he has done to himself.

Moore does not need permission from that guy to use the televised footage of him, NBC or CBS or whatever owns the rights to that footage, which I am sure he was paid nicely for.

If this guy ends up winning, I am going to sue the Bush administration in an enormous class action lawsuit for "loss of international reputation".
