LAFAYETTE, Ind. -- One day, the agricultural landscapes of the heartlands could feature more than traditional stalks of corn. Fields of the mushrooms known as morels may soon populate farmland across the country. Or better yet, a tree in your own yard could help you grow the tasty mushrooms.

Stewart C. Miller of Lafayette, Indiana, has patented a process to inoculate trees with the morel mushroom fungus. Under the right conditions and with the proper host, Miller says, anyone can become a morel farmer.

For centuries, morel (Morchella) mushrooms have attracted mushroom lovers because they are delicious, fun to hunt for, and provide a great way for families and friends to spend time together. Yet hunting for mushrooms has its drawbacks: Novice morel hunters need to take particular care in differentiating edible morels from poisonous ones. Miller's invention removes this guesswork. "Once you grow your own morels, you won't have to go hunting or enlist an expert to spot poisonous mushrooms," Miller comments.

Miller, who studied biology at Ball State University, became an avid morel mushroom hunter as a child. He began his research on growing morels while teaching biology in 1972. In May 1992, he made his big discovery, writing in his journal, "It's a simple symbiotic pact between the fungus and the tree!"

However, it took ten years to prove his theory. Using a high-tech microscopic camera, he photographed the morel fungus entering the root of an ash tree. He then inoculated elm trees with the fungus and successfully cultivated morels. Miller filed for his patent in 2002. Finally, in June 2005, Miller received "Cultivation of Morchella (Morels), Patent Number 6,907,691."

Morels, which look like sponges, prefer to live in other plants. The host plants grow faster and healthier with the fungus in their roots, and the mushrooms thrive in the moisture and warmth of the host. The magic occurs when the process of "symbiotic disruption" takes place: The tree begins to die and signals the fungus inside to withdraw and form hardened nodules underground.

"The death of the tree sends the morel fungus packing," states Miller. "In spring, the nodules swell with water and pop into big yellow mushrooms above ground. I envision bright fields of mushrooms across the country."

How the fuck can you "invent" cultivation of something? Is he trying to say that no-one else can grow them? Who invented cultivation of oranges? Is it O.K. for me to plant my own Orange tree the same way they initially did it?

morels dont look like sponges, they look more like an inside-out brain on a stick, or dehydrated swiss cheese on a stick.


I think its cool that this guy has spent so many years trying to figure out how to cultivate morels. He finaly found a method that was sure-fire and didn't want anyone else along the way to try and take the claim for discovering it.

Yeah, information like this should be shared with home cultivators. I can see him patenting his kits, but not Morel cultivation in general. That's ridiculous.

Without reading the claims on his patent, you don't know what his patent covers.  Don't be so quick to jump to conclusions.  :wink:

It just looked odd to me to see someone listed as the inventor of cultivating something. O.K., you can't grow them without involving a tree. How long would it have taken for someone else to also figure that out? That doesn't sound like an invention, it sounds like a discovery that he should just contribute to the Mycological community.

He's worried someone else might also sell inoculated trees? So what if they do? he can still sell his and I'm sure he would have and will sell a lot of them either way. :shrug:

O bow before me I am the god of Morels cultivation. pfft

So I bet this dude grows his own A. Muscaria and Panthars, if he figured out how to do the Morels. I just wonder though will the morels taste as good? I mean Salmon from the farm is nasty compared to Salmon from the river. Gotta say this though Cubes grown on Rice crispies sure taste better than cubes from the cow dung.

thatd be like PF patenting the cultivation of magic mushrooms
obviously not possible since therye illegal
but if this method works
a patent wont stop other from using it.

There is a lot of confusion about how patents work. You cannot simply patent "mushroom cultivation". PF could have patented his method of cultivation, but not cultivation in general. The patent in question, 6907691, makes 37 claims. All of these relate to the cultivation of Morchella ascocarps using mycelium and a tree seedling. If you can come up with a way to cultivate Morchella ascocarps that doesn't use a tree seedling, then you are not in violation of the patent.

To help the lazy, here are the 37 claims made by the patent:

A process for cultivating Morchella ascocarps using mycelium and a tree seedling, the tree seedling having a root system and a shoot system, the process comprising the steps of: inoculating the root system with the mycelium to produce an inoculated tree seedling; stimulating the mycelium to form sclerotia by distressing the inoculated tree seedling; and inducing said sclerotia to produce ascocarps.

2. The process of claim 1 further comprising the step of cultivating the mycelium by the steps of: introducing spores onto a culture medium; and incubating said spores until said spores produce the mycelium.

3. The process of claim 2 wherein said step of inoculating the root system with the mycelium comprises: introducing the root system of said tree seedling into said culture medium; and incubating said culture medium until the mycelium has infected the root system.

4. The process of claim 2 wherein said step of inoculating the root system with the mycelium comprises: adding a planting medium on top of said culture medium; placing at least one tree seed on top of said planting medium; germinating said tree seed into the tree seedling; and growing the tree seedling until the root system is infected with the mycelium.

5. The process of claim 1 further comprising the step of cultivating mycelium by the steps of: introducing a plurality of spores into a container of culture medium; placing said container of culture medium in a planting medium; covering said culture medium and said planting medium with a germinating medium; and incubating said spores until said spores produce the mycelium.

6. The process of claim 5 wherein the step of inoculating the root system with the mycelium comprises: placing at least one tree seed in said germinating medium; germinating said tree seed into the tree seedling; and growing the tree seedling until the root system is infected with the mycelium.

7. The process of claim 1 wherein said step of inoculating the root system comprises: introducing spores onto a culture medium; introducing a tree seed into a planting medium; simultaneously incubating the spores and the tree seed until said spores produce the mycelium and the tree seed germinates into the tree seedling; placing the tree seedling on the culture medium; and incubating the culture medium until the mycelium has infected the root system.

8. The process of claim 1 wherein said step of inoculating the root system with the mycelium comprises injecting the mycelium into the tree seedling.

9. The process of claim 1 wherein said step of inoculating the root system with the mycelium comprises grafting a portion of an infected tree seedling onto the tree seedling.

10. The process of claim 1 wherein said step of inoculating the root system with the mycelium comprises growing the tree seedling in close proximity to an infected tree.

11. The process of claim 1 wherein the tree seedling is an elm tree seedling.

12. The process of claim 1 wherein the tree seedling is an ash tree seedling.

13. The process of claim 1 wherein the tree seedling is an apple tree seedling.

14. The process of claim 1 wherein the tree seedling is an oak tree seedling.

15. The process of claim 1 wherein the tree seedling is a cherry tree seedling.

16. The process of claim 1 wherein the tree seedling is a peach tree seedling.

17. The process of claim 1 further comprising the step of planting the inoculated tree seedling into the ground.

18. The process of claim 1 further comprising the step of planting the inoculated tree seedling into containers.

19. The process of claim 1 further comprising the step of growing the inoculated tree seedling for at least one growing season.

20. The process of claim 18 further comprising the step of growing the inoculated tree seedling in said containers in a climate controlled environment.

21. The process of claim 20 where in said climate controlled environment includes the simulation of at least one growing season.

22. The process of claim 1 wherein said distressing the tree seedling comprises severing the shoot system from the root system.

23. The process of claim 1 wherein said distressing the tree seedling comprises defoliating the tree.

24. The process of claim 1 wherein said shoot system of said tree seedling comprises leaves and said distressing the tree seedling comprises smothering the leaves.

25. The process of claim 22 where in said step of stimulating the mycelium to form sclerotia further comprises allowing sclerotia to develop for at least one growing season after the severing of said shoot system.

26. The process of claim 1 wherein said step of inducing said sclerotia to produce ascocarps comprises providing conditions conducive to the formation of ascocarps.

27. The process of claim 26 wherein one of said conditions comprises temperatures in the range of about 18.3.degree. C. (65.degree. F.) to about 29.4.degree. C. (85.degree. F.).

28. The process of claim 26 wherein one of said conditions comprises providing sufficient water.

29. A process for cultivating Morchella ascocarps comprising the steps of: cultivating Morchella mycelium; inoculating a root system of a tree seedling with the mycelium to produce a symbiotic relationship between the tree seedling and the mycelium; terminating the symbiotic relationship between the tree seedling and the mycelium to produce sclerotia; and inducing the sclerotia to produce ascocarps.

30. The process of claim 29 wherein the tree seedling includes a shoot system and wherein said step of terminating the symbiotic relationship includes severing the shoot system from the root system.

31. The process of claim 29 wherein said step of terminating the symbiotic relationship includes defoliating the tree.

32. The process of claim 29 wherein the tree seedling includes leaves and wherein said step of terminating the symbiotic relationship includes smothering the leaves.

33. The process of claim 29 wherein said step of cultivating the mycelium includes introducing Morchella spores onto a culture medium; and incubating the spores until the spores produce the mycelium.

34. The process of claim 33 wherein said step of inoculating the root system with the mycelium includes introducing the root system of the tree seedling into the culture medium; and incubating the culture medium until the mycelium has infected the root system.

35. The process of claim 29 wherein said step of inducing said sclerotia to produce ascocarps comprises providing temperatures in the range of about 18.3.degree. C. (65.degree. F.) to about 29.4.degree. C. (85.degree. F.).

36. The process of claim 33 wherein said step of inducing said sclerotia to produce ascocarps further comprises providing sufficient amounts of water.

37. The process of claim 29 further comprising the step of growing the tree seedling in symbiotic relationship with the mycelium for at least one growing season.

It can, and will, with a court order. The courts will almost always issue an injunction in a patent dispute and monetary damages can be quite large if the courts find in favor of the patent holder.

I still say it's the discovery of a process, not an invention.

If you altered something in the process you should be able to change it into your own process and not violate the silly patent.

If you figure out a way to cultivate Morchella ascocarps using substance-X and brown rice flower, then you could patent (or publish) your own method and would not be in conflict of his patent. You cannot legally cultivate using tree saplings, as outlined in his claims, without his permission. If you are going to be growing for your family and friends, he probably isn't going to care. If you are going to start farming to make zillions of dollars, he is probably going to want a slice of the pie. Either way, it was his time and effort that went into the discovery, and as such, he should be allowed to benefit from it.
