Well here it is, you can have some mushrooms if you belong to a certain religion.

I remember a member in the pub going on about how he could "trip and be spertial" on peyote. He was disrespectful though.

Yup. It all comes down to tribal law, and depends on if you live on tribal land. I DO know for a fact that in AZ you can get away with this on reservations and such.

We have alot of resevations in MN and it depends on the tribe and thier beliefs because some of the tribes use it for rituals and such, not all do, you can usally find out if the ones in your area do it by checking the web

Yeah peyote is legal for use by members of the Native American Church, I think I've seen something about it in National Geographic, and the supreme court recently ruled that use of Ayahuasca was legal for members of the church that use it as a sacrament. Dragon

welll, down here in ghetto arizona, we have lots of indians and mexicans runnin around.....SO there are reservations... But cubensis doesnt naturally grow in AZ?

Their's indians all over the place in washington state. Don't know why that would suprise anyone.
To answer your quesion: It's all about tribal law OR/AND who busts you.
From what I understand:
Say you get busted by the tribal police(yes most nations have such a thing). Then, depending on tribal law, you have a chance of not going to jail that day.
If however you get busted by some feds or county/staters that happen to be hanging out in the area, you're probably going to jail that day. Depends on the tribal laws and the police policy.
Then you can petition the tribal court(yes most nations have such a thing) asking them to take the case themselves. This would only be wise if it wasn't against tribal law or that the penalty is not severe in that nation. But.. at least around here, they will tell you to go f yourself unless you were with one of their tribe and that person also got arrested or you are part of their tribe and are in 'good standing' with the tribe.
As a matter of practice, I would just assume it's equally dangerous from a legal perspective. If you are that serious about the subject, contact an attorney that has dealings with the nation you are considering doing this at. It's better to get it from someone who knows how your local system works that from a buncha fungi fanatics.

Cappa hit right on the nose , and for the one thinking of joining a tribal church, up here you have to prove your blood line and then you might have a chance but if they think the only reason you are joining is for the fun stuff(lol) they will not permit it till you have proven your self a worthy sioux or chippawa. I have about 1/64 in me and that will not cut it with most tribal rules up here you have to be at a min 1/8 to even get a close look

Technically its illegal, and peyote is only legal, like said, for memebers of the NAC. However, also stated, its really up to local tribe, cause honestly, the FIBI isnt gonna crack down on some to some reservatoin to some indian fool with a martha in his teepee. You'd think, though, that we would give them full rights to their own laws on their land. It kinda bothers me to be apart of a heritage that was so cruel... oh well though... i do what i can now.

They are the same... if she is a registered member of the Native American Church, she can participate in the peyote fest in south texas once a year (out by Laredo). Also there are registered peyote farmers that sell to members of the NAC.
As for mushrooms though, dont expect any special treatment cause shes a native american... nothing is different... at all... except that you have a cool g/f.

here is my homeboy Salvador Johnson.
The summer after graduating high school a friend and myself took a very spontaneous road trip lasting 10 days in search of Peyote. We even had maps, books, and had become exceedingly knowledgable in regards to it.
After driving all the way to a little reservation in arizona, and only able to buy a few buttons, we ended up stopping in a little town called Oilton in Texas. We headed into a bar that looked like every bit of "Desperado" and found an ancient mexican bartending to an empty bar which looked like it hadn't been patroned in years.
He doesn't card, and we buy a few beers, chat the guy up and find out that a peyotera lives only a few blocks away, as well as his church which is next door.
So, we find this church, peyote growing in their front yard.... yadda yadda we talk to Salvador Johnson who showed us plenty of buttons, gave us some history of his occupation and whatnot.
We had too much respect after our entire journey to even ask if we could procure or buy some buttons, but I have some amazing pictures of it all, especially a good one of him holding up a 7 ft rattlesnake skin that he was very proud of.
