DUI Story....desperately seeking advice

Man, having such a great time at a kickback at my buds house, few beers, not too many, especially for me, I know i made a mistake by driving, but i literally live 2 minutes away. So I get rolled, cop says my taillight was busted, it was, he says he thinks he smells alcohol, I'm only 20 mind u, has me step out of the car to perform a field sobriety test, pass it with no problem, then has me take a Breathalyzer. I blow a .09, 1 tenth over the legal limit, however I'm only 20 so that doesn't even matter,but does have some relevance. He cuffs me, tows the car. arrests me for DUI. I fill out some paper work, but i am 90 percent certain that i did not sign or receive a citation the next morning when I was let out. A court date was told to me and the others in the drunk tank that night, however the rest of the guys in there all had citations, I'm pretty sure they completely forgot about mine, now i do have some DUI pink papers that i signed and such, but no citation and no court date. Is it possible that with the right moves that this thing could slip thorough the cracks, who else can i goto for advice except the wise drugtakers that shroomery provides for me, any help, advice or opinions would be greatly appreciated.

It would be wishful thinking to hope that it would fall through the cracks. Don't count on it. Go on as if it didn't and if it did, hey, it's a bonus in your situation.
People make mistakes, just happened to a friend of mine actually. Do what you have to do and move on.

you see, i think this is why america has a violence problem. I am 18 (legal drinking age here in aus) and one night I spent ALL FUCKING NIGHT drinking like a fish. The next morning I woke up and hit the piss again, drank 3 bottles of REALLY GOOD wine before passing out on a carpet. I passed out about 10:00 am and woke up at 10:30 pm. I assumed I was sober (I felt sober, but we all know how misleading that can be) and got in my car and drove home.
One of my headlights is busted, and I drive a pretty sporty (loud) car. I get pulled over for the headlight. The cop put me on the breathaliser unit (I dont know about the US, but down here every cop car has a little hand-held breathaliser they use to determine whether you have ANY alcohol in your system. if it says you do, they take you back to the station for the BAS (deadly accurate) test).
She said "the breathaliser says you've got grog on ur breath, have you drank anything today?" I insisted I hadn't drank anything, but she said whatever and said I had to go to the station with her.
In aus, if you blow something on the roadside test THEY DONT CUFF YOU! (unless you're already violent). Why should they cuff someone who poses no threat? I dont know of any officers that get assaulted/killed because they didn't cuff someone. In the US, it seems they cuff EVERYONE for ANY CRIME no matter HOW PETTY IT IS! I don't get it. We even get to ride front seat with the cops if they are working solo. It seems the US police dont trust anyone and every person poses a threa (shatterproof glass between driver seat and 'holding cell' in the back of the car :P)
ANyway, long story short, they took me to the cop shop and put me on the BAS, luckly for me whatever miniscule amounts of alcohol that were in my system had dissipated between the roadside test and the BAS 45 mins later.
But my license had expired THAT NIGHT (got caught doing 120 km/h in a 50 km/h zone 2 months before hand) so I got let off with a warning because I said I didnt think it expired until the next day... lol suckers.
THIS IS WHERE I PROVE THAT COPS ARE REAL CUNTS!!!
They were obviously real pissed that they couldn't bust me for DUI so they said "well your license has expired so we cant let you drive home"
I said "well for fucks sake, I live like half hours drive away, can you take me home?" (it was about 12:00 am)
The cop said "well, no sorry we are real busy... (this was a lie, it was a fucking Sunday evening) so you will just have to walk home"
I said "WHAT? YOU MEAN WALK FOR 3 1/2 HOURS JUST BECAUSE YOU CAN'T BE FUCKED TAKING ME?"
"yeah"
"well fuck you cunts..."
I had been really polite to them all night but when they just basically kicked me out onto the street, I thought fuck that.
So for the next hour while I was walking back to my car, I was ringing 000 (our emergency number) saying "MR POLICEMAN, PLEASE CUNT, YOU FUCKERS JUST DUMP ME IN THE MIDDLE OF NOWHERE AND DIDNT EVEN CHARGE ME FUCKING TAKE ME HOME"
each time he said "someone is on their way now, wait where you are" but noone ever came. So I rang 000 about 30 times that night just saying "I need a lift" then hanging up. On one occasion he said "if you continue harrassing and abusing the emergency service number, we will have you arrested"
I just said "FUCKING GOOD AT LEAST MAYBE THEN I'LL GET A LIFT SOMEWHERE AND YOU WON'T DO SHIT ANYWAY BECAUSE I'LL JUST TELL EVERYONE ABOUT THIS BULLSHITTERY AND HOW THE TASMANIAN POLICE FORCE IS FUCKED ANYWAY AND YOU'RE ALL EGOTISTICAL CUNTS AND YOU WON'T HAVE A LEG TO STAND ON IN COURT BLAH BLAH BLAH" basically ranted for a good 5 mins (they can't hang up on you). Eventually I got back to my car and just drove home, breaking speed limits by 60 or 70 km/h the whole way lol....
so yeah, fuck the pigs... they are cunts.
One mate of mine has lost his license for speeding, when they took it to court the arresting officer didn't show up, so they threw it out of court and he got his license back, so hopefully it happens to you

It could slip through the cracks, i've had like 1 or 2 minor under the influences slip and a no insurance ticket..nothing as come of it and its been years...but uhm uh...good luck

I don't know about the slipping through the cracks stuff, but I recently got a DUI in FL and can tell you what my lawyer told me. The portable breathalyzers supposedly do not hold up in court as evidence due to their inaccuracy. Since you are under 21 it ,may not matter. When I got my DUI I had to do the breathalyzer at the jail on a big fancy one. I would suggest getting a lawyer. A DUI will jack the insurance and be a very expensive pain in the ass if convicted. A lawyer may be able to get the charge reduced to something other than a DUI for you.

thats what i stated before. They use the portable one to see if you have any detectable traces of alcohol, if it says you do they take you back to the station to the BAS to see exactly how much alcohol you do have,

You passed the test, the portable tester picked up your binaca or any other alc based breath spray, Tell your lawyer to say they refused to take a blood test when you asked for that.

exactly, I have a portable breathalyzer, and I put that to the test. I washed my mouth out with listerine, it read a perfect .08 I'd concur that binaca would do the same...

Face it you screwed yourself. As i did to when i was 20. All i can say is pay up do your classes and bend over and have a nice crack full of lube.
I can point out the mistakes and my only advice would be obvious.
1. always check your lights! 2. if you live two minutes away WALK! 3. Know how alcohol works. one drink ever 1 1/2 hours is the rule. But for a minor it doesn't matter. I blew a .01 but i still lost my license for 6 months
with the whole paper thing. You signed stuff and probably got finger printed, just because they didn't give you the actual citation doesn't mean it doesn't hold. Its up to you to call the court and ask if you have a court date. Do that every week to keep updated. They love to screw you double when you fail to appear.
