Prescription drug bust at CU [CO]

Prescription drug bust at CU
May 9, 2006 - dailycamera.com

A 19-year-old University of Colorado student is accused of dealing prescription drugs from his Willard Hall dormitory room.

James Michael Lea, of St. Louis, was arrested over the weekend and possibly faces 11 felony charges of possessing and distributing prescription drugs and LSD.

CU investigators on Monday raided Lea's dorm room, No. 261, and reported confiscating 82 items including a stash of about 30 pills in a red Nike bag that included Oxycontin, Xanax, Phenobarbital, Ambien, Lunesta, Temazepam, Clonazepam, Vicodin and Percocet. Also discovered were tools used to weigh, measure and package pills, police reported.

Lea's roommate, 19-year-old Joshua David Olson, also was arrested Monday on suspicion of possessing two Lunesta pills and drug paraphernalia and for underage drinking.

Both remained at the Boulder County Jail on Monday night.

Olson's first court appearance is scheduled for today, and his bond is $1,500.

Lea was in court Monday and is expected to be formally charged Thursday. His bond is set at $5,000.

Police were called to Willard Hall on Sunday morning. A housing security officer said he was worried after seeing Olson vomit in the men's bathroom and then stumble back into his room, according to an arrest warrant.

Officers were initially unable to wake Olson up, the warrant stated, and paramedics were called. When he did come to, Olson told police he had drunk a "40."

Lea allowed police to search the room and directed them to where drugs were kept, the warrant stated. Lea told officers he had several books and magazines about manufacturing drugs because he likes to be informed about what he consumes.

Lea was arrested Sunday morning. Olson was medically cleared and allowed to sleep off his intoxication before police took him into custody.

Lea has been arrested twice before in Boulder — the first time in December on suspicion of stealing spice jars from McGuckin Hardware, and a second time in January after CU police reported catching him on camera cutting open a UPS box in the police headquarters lobby and rifling through it.

When CU officers responded to his dorm room after his second arrest, Lea told the officers that he was mad at police and was looking for a way to get back at them, the report stated. A small amount of marijuana was confiscated from him at that time, police reported.

The cases were combined, and Lea pleaded guilty last month in Boulder County Court to possessing drug paraphernalia and criminal mischief, according to court documents. He was given a 12-month deferred sentence and ordered to serve 24 hours of community service.

On Lea's online Facebook profile, he lists his school concentration as chemistry and a favorite quote from Salvador Dali: "I am drugs."

CU police Lt. Tim McGraw said the cache ranked as one of the campus' biggest prescription-drug finds. He said any follow-up as to where the drugs came from would be handled by the Boulder County Drug Task Force.

"Even though this is a substantial amount, by campus standards, it's likely the tip of an iceberg," McGraw said.

Willard Hall is where police found the body of Jesse Gomez on April 9. Investigators still are awaiting toxicology reports to determine what killed the 18-year-old sophomore from Lakewood.

McGraw would not say whether there was a connection in the cases.

"We'll certainly go where the facts lead us," he said.

Wait...

...why on earth would he do that?

Well if it is a dorm room doesn't he not have a choice? I'm actually not very familiar with civil liberties in a dorm room enviroment, but it would be good to know since I will be living in one next year. If anyone could enlighten me that would be cool

I think it varies, you should be able to check out the dorm policies online.

But since the police mention it in the report, I assume that they did in fact need consent to enter. If police don't need consent to do something, they'll just do it without asking. If they ask, they need consent.

In my experience with dealing pills, unless you buy at least 100, even rolls, it is not worth it, economically, to sell.

I'd say this kid was either on the tail end of his supply and was very lucky for that, was just supporting him own habit, or was just doing everyone a favor by being a friendly dorm pill seller. From the details in the article I'd wager it was the latter.

The search was illegal by the way, so he will probably get most if not all of the charges dropped.
