Mexico set to decriminalise pot and cocaine

MEXICO CITY (Reuters) - Possessing marijuana, cocaine and even heroin will no longer be a crime in Mexico if the drugs are carried in small amounts for personal use, under legislation passed by the Mexican Congress.

The measure given final passage by senators late on Thursday allows police to focus on their battle against major drug dealers, the government says, and President Vicente Fox is expected to sign it into law.

"This law provides more judicial tools for authorities to fight crime," presidential spokesman Ruben Aguilar said on Friday. The measure was approved earlier by the lower house.

Under the legislation, police will not penalise people for possessing up to 5 grams of marijuana, 5 grams of opium, 25 milligrams of heroin or 500 milligrams of cocaine.

People caught with larger quantities of drugs will be treated as narcotics dealers and face increased jail terms under the plan.

The legal changes will also decriminalise the possession of limited quantities of other drugs, including LSD, hallucinogenic mushrooms, amphetamines and peyote -- a psychotropic cactus found in Mexico's northern deserts.

Hundreds of people, including several police officers, have been killed in the past year as drug cartels battle authorities and compete with each other for control of lucrative cocaine, marijuana and heroin smuggling routes from Mexico into the United States.

The violence has raged mostly in northern Mexico but in recent months has spread south to cities like vacation resort Acapulco.

Under current law, it is up to local judges and police to decide on a case-by-case basis whether people should be prosecuted for possessing small quantities of drugs, a source at the Senate's health commission told Reuters.

"The object of this law is to not put consumers in jail, but rather those who sell and poison," said Sen. Jorge Zermeno of the ruling National Action Party.

Fifty-three senators voted for the bill with 26 votes against it.

Huzzzahhh!

Well it's a big step in the right direction. Though Mexico would be wise to make it a government or corporate business, and regulate/tax it. And then anyone else not authorized to sell drugs would be punished. As it stands now, well, someone has to sell the personal quantities to the people: why not make it the government, so they can get a cut of the money?

Seems like everybody but the US is getting the point, especially now that Canada and Mexico are relaxing regulations. But watch for the US to not stand for it. I bet they'll put enough pressure on Fox that the bill won't get signed, or pressure Mexico to repeal it...

that is awesome as shit.. but how are these people going to get their "personal quantities".. its still going to require cartels and dealers to capture the market.. the only way to go is to make it controled by the government.. as mentioned before on a post

List of maximum allowable drug quantities approved for personal use by Mexico's Congress:

Opium (raw, to be smoked) 5 grams
Heroin, 25 milligrams
Marijuana 5 grams
Cocaine 500 milligrams
LSD .015 milligrams
MDA 200 milligrams
MDMA (ecstasy) 200 milligrams
Mescaline: 1 gram
Peyote: 1 kilogram
Psilocybin (concentrate, pure, active ingredient) 100 milligrams
Hallucinogenic mushrooms (raw, off the farm): 250 milligrams
Amphetamines: 100 milligrams
Dexamphetamines: 40 milligrams
Phencyclidine (PCP, or Angel Dust) 7 milligrams
Methamphetamines: 200 milligrams
Nalbuphine (synthetic opiate): 10 milligrams

It will be very interesting to see the results of this change in the long-term. Will more suppliers be apprehended? What effect will this have on drug-based political corruption? Will drug use increase? Will this be an issue for pregnant and nursing women?

Unfortunately, with all the corruption and fucked up shit already going on in Mexico, this good idea will probably fall through, and something will happen that will enable the DEA, etc. to say "See we told you so"
