I wouold like to bring up a fine point about copyright infringement and your "I don't give a shit". comment.

I just got through such a copyright infringement ordeal where I had permission to use a photograph of someone elses, onl;y that person knew nothing about the permissio9n of said use and the lawyers and I settled ouot of court.

I am referring to two imnages in my book Teonan?catl: Ancient Shamanic and Contemporary Mushroom Names of Mesoamerica and Other Regions of the World.

The photos graphs were loaned to me by the noted mexican Mycologist Gast?n Guzm?n.

That letter was in 1993, I then wrote the book in 1997-1998. IT is posted at my site.

Here are a few of the emails from Jim Jacobs to me before his lawyers contacted me of the matter and then I settled out of court.

Now I will show you the letters from James Q. Jacobs (the Photographer, who also has several mushrooms with his name on them).

I used two images. P. hoogshagenii var. hoogshagenii and P. mexicana.

Here are the first emails I got from him about this matter

The images have now propagated online. If you are responsible for any of this, correct it. At some point, I need to turn this over to the proper authorities and have the theft of my intellectual property rights enforced

I might mention that Jacobs has three or four degrees and his threats to sue me were real as the obnes aI once threatened Hippie3 with for selling my copyrighted material. Alal in all I just came to the conclusion he was not worth the effort but My nice days are over as far as copyrighted materials go.

To make some matters worst, I have letters form R. Gordon Wsson gicen me permission to use certain portions of his book and also had given me permission to visit and go through hsi personal library at harvard.

Since he Died, harvard devided all of his collections into about ten or more different libraries at Harvard and I was actually denied permission. harvard told me sinc ehe was dead his letters had no merit because the library named in his honore at Harvard where his materials were once stored is no longer a library and his worls were split up.

To be a vetreran and be denied access to a ny6 library in America is a very unamerican activity.

But again, it is his family the children who do not want outsiders looking at his data.

A few Harvard scholars with h whom I am friends for more than thirty years ahve told me, if you did not go to Harvard, do not expect them to let you come into their libraries and research.

Although my attorney said the letter to me from Dr. Guzm?n protected me form a suit, I sttled w becasue I do nto need this shit floating around by someone saying I stole their intellectural copyrighted materials, and all of my images created fefroe April are on record on cd and in books with the U.S. Library of congress and are my copyrighted materials and partial copyright of Shroomster Enterprisers and their two Owners.

So give me a fuckin break.
