i been reading on the law here in texas and i noticed some odd stuff.
first, the law is kinda hard to read, so i may have misinterpreted it. you can get the pdf here: http://www.capitol.state.tx.us/statutes/docs/HS/content/pdf/hs.006.00.000481.00.pdf
now from what i understand, the drugs are broken into 4 groups (1 is worst, 4 is least). heres some recognizable names from each group (from what i understand):
group 1 - heroin and opiates, meth, morhphine, codeine group 2 - dmt, mescaline, mdma, psilocybin (shrooms), tcp group 3 - lsd, diazepam, peyote, steroids, and very small quantities of some other group 1 & 2 drugs group 4 - very small quantities of certain group 1, 2, & 3 drugs
theres a whole section just for marijuana (spelled marihuana for some reason).
lsd is apparently less dangerous than shrooms?
now there are 2 main charges there. possesion, and manufacture with intent to deliver, each with different penalties based on quantity of the drug. the weird thing is, the quanity is measured "...by aggregate weight including adulterants or dilutants..." i guess this would be used to say measure coke that isnt completely pure.
my point here is that mushrooms are about 1% psilocybin (roughly). so if you get caught with 50g of shrooms, thats only .5g of psilocybin, which is the controlled substance were worried about. BUT, does the WHOLE shroom count as "adulterants or dilutants"? if so, and youre charged with manufacture with intent to deliver, you go from a state jail felony to a first degree felony...
so heres the breakdown for group 2 (which includes shrooms)
manufacture or delivery state jail felony - less that a gram 2nd degree felony - 1 - 4 grams 1st degree felony - 4 - 400 grams more than 400 grams - 10 - 99 yrs in the institutional division of texas department of criminal justice, and not to exceed 100,000 fine
possesion state jail felony - less than 1 gram 3rd degree felony - 1 - 4 grams 2nd degree felony - 4 - 400 grams more than 400 grams - 5 - 99 yrs in the institutional division of texas department of criminal justice, and not to exceed 50,000 fine
ok i just found the typical punishments for the varying degrees of felony...
first degree - 5 - 99 yrs in the institutional division of texas department of criminal justice, and not to exceed 10,000 fine second degree - 2 - 20 yrs in the institutional division of texas department of criminal justice, and not to exceed 10,000 fine third degree - 2 - 10 yrs in the institutional division of texas department of criminal justice, and not to exceed 10,000 fine State Jail felony - 180days - 2 years in state jail, and not to exceed 10,000 fine

Pretty retarded shit. The mushrooms would absolutely be weighed as a whole.
It is somewhat pleasing to see that both possession and intent to distribute go up to large amounts by technical definition. Naturally, it would never be enforced that way. But not having it written in law that it's impossible to have more than an ounce of something (for example) without being a drug dealer leaves decent arm space. Gee, you've got enough for THREE good nights there in your backpack. God knows you don't have the balls to take something on three seperate occaisions without going back to the dealer. Besides, the more times you have to buy the drugs, the more chances we get to gnab you doing it! Fucktards.

the rules even specified taht peyote was ok if it was part of a native american religios ceremony lol
i guess mescaline is like refined or something?
