I got popped the other night for speeding at 2:30 in the morning. I was going a whopping 3 miles over the limit. He ran all my info and then asked me to step out of the car because it smelled like a drunk, which was my passed out friend in the passenger seat. He asked me if I had been drinking and Of course instead of lying and just saying no, I told him the truth. I don't drink, at all, ever. I chink he thought I was lying and started to give me sobriaty(sp)tests. I went through 5 different tests, 5 of them. He never once even mentioned the breathalyzer.Once he found out I was the fucking DD and was actually sober. He said ok your free to go. As he is pulling out I realize my car has died. He is still behind me and i start waving like a madman. I swear he looked right at me and took off. I wake the drunk up and tell him whats going on and to stay in the car. I go down the road to a friends house to get a jump. Of course he is not home and when i get back ANOTHER cop is there harassing my drunk friend. He puts us both in the back seat of the cop car and runs all our info again. Tells us that we can't leave the car there on the road with no lights because even the flashers were dead. The second cop turned out to be nice and called my brother to come get me. But it was a shitty night. At least no ticket though.

That sucks, I hate it when cops go and do all of that shit.. I got pulled over for a burnt out headlight once, and also since my license plate lights weren't working... BOTH times they searched the car for anything, but only gave me a warning when they didn't find anything..idiots. The one time that I had been drinking and had the smell of strong booze all over me, the state cop just gave me a ticket for running a red light that had just changed, and I didn't feel like slamming on the brakes.

Just FYI, field sobriety tests are illegal and an infringement on your rights. Never let a cop tell you that you must take them.
Sucks you went through all that harassment, but it could have all been avoided if you knew your rights well enough. I lucked out, my wife works for a criminal defence attorney and is also in law school, but most dont have a walking talking law book sitting next to them.
Know your rights and dont give the cops the power trip they so desire to fill the gaps in thier own personal lives.

if you decline a breathalizer they can...
not a field sobriety though. Keep your lawyers card in your wallet if you are going to have a run in with the police. It is fun to watch a cop backpeddle once a lawyer is involved.

I understand, and thats how they get ya. They use thier power illegally while trying to make a bargain. It amazes me how many people are fooled by a cop being nice to them. They are doing thier job, and enjoying thier power trip. To give into illegal searches just lets them know the public is going to continue to give up thier rights so they as officers can continue to hold power.
A police officer really holds NO power, other than they can detain you. They still have to abide by the law though, however they will bend those laws as much as you allow.
I dont care if my car is spotless, if a cop asks to search, i will politely tell him no. If he insists on searing anyways, I will call my lawyer, or make it known to any witnesses that I am not consenting to a search.
Cops are a very frat like organization, but the more people the stand up for thier rights, the more power the police lose.

im not sure about the law in other states, but in washington state you can refuse the field sobreity tests, you can also refuse the breath alyizer tests that is done in the field, but they will then take you to the station were you have to blow or they will suspend your liscence. the field tests are designed to make you fail even if you are sober. sorry i dont have any website sources for any of this its just straight from the lawyer.
