See any oddness in this?
    #5374929 - 03/07/06 04:28 PM (18 years, 2 months ago)

One of my friends obtained some P.Torch, shredded it down to powder and then sold it on ebay. He sold it on ebay listed as "P.Torch Incense" and did a very good detail. The transaction is all done, he sent, payer paid. Good and done.

The other day he realized that the buyer has only 1 previous buy before him, and that was another shaman product. He started to get wierded out by this and say "wonder if its some detect or something checking shit out online" due to low buys of course.

I told him chill out, as long as he sold it as what he stated then he should be good. He also said he sent an invoice type thing with the product, it stated how to light the p.torch incense (obv made up)!

I just told him, its fine, dont worry. But you should'nt be selling shit like that online anyway...its draws UN-NEEDED attention.
He said no more, but is paranoid that someone will be knocking on his door or something now.

What is your opinion on this situation?

no. its not illegal to possess when its sold as such, and told by the seller to be used in the selling manner.

yeah, then I wouldn't worry about it. But I still wouldn't be selling such items over ebay.

"no. its not illegal to possess when its sold as such, and told by the seller to be used in the selling manner."

While I see your point clearly, I really wish people wouldn't treat it so "open and shut". It is not a schedule I substance, true. But very few plants are actually listed by name.

The point you WISH to make is just that it 99%+ of the time flies under the radar. This is completely true. The substance is EXACTLY the same as mushrooms regarding scheduling. The biomaterial isn't scheduled, what it contains is. Mushrooms aren't scheduled, they are just more well known. They wouldn't need to change a single law to bust each and every person who owns it for possession... they need only change their policy.

Of course, the point is that this doesn't happen (yet). Much more illegal things are sold online every day. Poppies are more illegal than cactus powder and even mushrooms, as it doesn't matter even if you could prove that it is for an art project. Your piece of art would be means for you to go to jail. Mushrooms being sold as incense (hah) would be technically more legal (using the san pedro, dmt plants, etc disclaimer) than selling poppies as decoration.

Neat stuff.

It's not worth stressing about. Nobody is going to go through the trouble of getting his information from eBay, then going to his home to arrest him for one auction, which was for some Peruvian Torch incense. It's ridiculous to stress about it. And why in the hell would the person having so few auctions worry him? That confuses me.

It is absolutely not ridiculous to worry about getting in trouble for selling powdered torch on ebay. Like I said, it is 100% legally equal to selling mushrooms. I'd agree that there's no need to worry about buying it on ebay, simply because you're a smaller fish.

Ebay has a history of being more than willing to work with law enforcement. A while back there were poppy sellers busted there, though it continued after that. If you're selling Kgs of the stuff on ebay, then by all means you could find yourself in some shit.

Even in Canada and the UK, there have been trichocereus related busts recently. The one in canada wasn't related to the dry stuff, but they charged him for only a couple plants he had growing. As a result, sporelab stopped selling their torch skin.

The UK bust was completely centered around the dry skin. Plants, including the there legal peyote, were seized as well. If these governments feel like stomping these things, why the hell wouldn't ours? They will, absolutely. And it's only a matter of time.

You're right to say that it's unlikely. And you're right to say the 1-feedback isn't some sort of tell tale giveaway. But to suggest that it's ridiculous to worry about selling schedule I, powderized (prepared) drugs on ebay is just plain stupid. Additionally, bringing so much attention to it in the most mainstream way possible is irresponsible. But it was clearly only about making a buck in the first place.
