Is this legal???

Is it legal for officers of the law (undercover of course) to approach you and ask you if you would like to buy drugs?
For example...if someone was at a show, could an undercover approach them and ask them if they wanted to buy some LSD...and then arrest them for some intent to buy bullshit or something?
Is this entrapment?

What they do with prostitution is set out a skanky-dressed cop on a slum street corner. She will not go up to you but it will seem as if she is an actual prositute so people will go up to her and ask for a fuck (or whatever) and that's when the cops come in to arrest. Similar thing would probably happen at a show with drugs. I don't know if they would ask you.

[QUOTE] The mere presentation of an opportunity or request by an officer that an individual commit a crime does not qualify as entrapment. An officer may engage a citizen in conversation and ask to buy an illegal substance -- even if they have no reason to suspect the person of illegal activity.2 They may offer to sell an illegal substance and arrest the buyer after the sale. Loosely defined, entrapment is a situation in which, if not for the actions of the police officer or police informant, the defendant would not have committed the crime. This defense is generally only successful in situations where law enforcement officers create a criminal plan, plant the idea of that plan into an otherwise innocent person's mind, and then instigate the plan for the purpose of prosecuting the suspect.

It's legal for them to do that, yes. Sounds like a sting operation.

Yeah... I'd give hella disclaimers.
Well, I don't know, I've never smoked marijuana, I'm not the kind of person who does that kind of thing. But if you think it's a good idea, maybe that's the direction I should start heading my life in.
Hehe... useless.

All through highschool I remember hearing about people storing drugs in their lockers, etc. Whenever I mentioned that the principal was doing random locker searches in the halls they'd all say "he has no right to do that, that's invasion of privacy!" Turns out a law had been passed giving principals permission to search all the contents of any locker in the school, long story short a bunch of people got screwed over because they thought the law would protect their privacy, don't fool yourself

I'm pretty sure the lockers can be searched by the princible at any point, because they are property of the school.
And im not sure, but i have heard that upon entering a school, you basicly lose all rights to defending yourself against unlawful search & seizure. Im not sure if this is actual law, or just kinda de facto, but its pretty hard to get out of a search at a school (of your backpack, or of you yourself) by calling on your constitutional rights. Its also got to do with most people in school are under 18, or atleast thats what they try and tell you. But the age doesnt matter in the real world. A 16 year old has the same right to deny a search as an 18 year old, i believe.

yeah they can, but if you ask them if there a cop, they have to tell you.....
however i doubt they would actually say there a cop.
Since when have cops followed the rules.

would they be allowed to try to convince you into doing something illegal? (buying, selling, etc) even after you've said no and refused?

Yes, they can persist to bother you if so inclined. Although they would probably leave you alone if you weren't interested. Their goal isn't to arrest as many people as possible, their goal is to arrest as many people who DO want to buy drugs as possible.
It's only entrapment if they really strongarm you into doing it, as in forcing you under duress to commit a crime.

How is that true? I was watching a prostitution sting on cops a few weeks ago and the dude asked the woman officer (diguised as a hoe) if she was a cop, and she said no. He was then arrested for trying to pay for sex.

That's one of the main myths about your rights and the police.
They DO NOT have to tell you they're a cop if you ask them. I don't know why people think that, but it is certainly not true - I actually talked to a cop about that once.
And as for entering a public school -- You do lose all rights to your privacy. The law was posted on little plastic things on the wall above doors when you entered at my high school. TCA Act such and such. It basically means you, your vehicle, and any of your belongings are subject to search at any given time etc.etc.
I mean really, when it comes down to it, the cops have the upper hand. Every time any of my friends or myself have tried or thought about trying to cite some constitutional rights, it doesn't mean dick. Very few people I have heard of have actually gotten out of something for a rights violation. It sucks.

It's simple... Just don't be an idiot, don't bring your drugs to school (you shouldn't have to in the first place) and if you are gonna carry drugs around, don't get caught and make sure you've hidden them pretty damn well...
I remember when I was 16 getting searched by a cop with 9 grams distributed between the left and right pockets on my pyjamas I was wearing under my pants (it was winter), I had already handed over the 2 grams they already knew I had (which for the record weren't actually mine) and I had only 15-20 minutes ago been drinking with some friends... Surprisingly I held it together pretty well, didn't give them a hard time, and just prayed that the cop didn't notice that lump burried deep in my pocket as he was patting me down, went over the damn things 3 times without noticing them, they also let me keep my unopened bottle of whiskey I turned over as soon as they started asking us questions...
Just in the wrong place at the wrong time while I just happened to be holding a lot of bud on me, every time I look back on that I can't help but think "shit, imagine if they'd found that, imagine if you'd gone with your initial response and reached into your pockets and pulled it all out". I was one lucky son of a bitch, and I hope that I never end up in a situation like that again, If I hadn't been slightly intoxicated at the time I would have probably been freaking out and would have given myself away almost immediately... Damn, that's just not one of those things you forget... Hell of a night though

Your rights being violated doesn't mean dick... to the cop. It does matter in court, if they've actually been violated, unlike a school setting.
