New Orleans gun confiscation stopped by court

Suuposedly, the orders were issued by the mayor for the gun confiscation that had been going on for weeks. But all levels of govt were participating in taking guns from law abiding citizens. No more. Only bad side to this is that they (govt) were able to get a good idea of what type of actual resistence to gun confiscationt there would be. I hope they realize that whatever resistence to their taking guns would pale to what would actually happen if they try it again or on a larger scale.

Major Victory For Firearms Owners And Freedom In Louisiana

Friday, September 23, 2005

(Fairfax, VA) -- The United States District Court for the Eastern District in Louisiana today sided with the National Rifle Association (NRA) and issued a restraining order to bar further gun confiscations from peaceable and law-abiding victims of Hurricane Katrina in New Orleans.

?This is a significant victory for freedom and for the victims of Hurricane Katrina. The court?s ruling is instant relief for the victims who now have an effective means of defending themselves from the robbers and rapists that seek to further exploit the remnants of their shattered lives,? said NRA Executive Vice President Wayne LaPierre.

Joining LaPierre in hailing the U.S. District Court decision was NRA chief lobbyist Chris W. Cox. ?This is an important victory. But the battle is not over. The NRA will remedy state emergency statutes in all 50 states, if needed, to ensure that this injustice does not happen again."

The controversy erupted when The New York Times reported, the New Orleans superintendent of police directed that no civilians in New Orleans will be allowed to have guns and that ?only law enforcement are allowed to have weapons.? ABC News quoted New Orleans? deputy police chief, saying, ?No one will be able to be armed. We are going to take all the weapons.?

The NRA also pledged that it will continue its work to ensure that every single firearm arbitrarily and unlawfully seized under this directive is returned to the rightful law-abiding owner.

The NRA was actually slow to respond initially. The info regarding the gun confiscations was not even under major headlines on their site for over a week after it was publicly known. I think they had a picture of some kid they gave a scholarship to and some other usless crap for major headlines. However, ppl contacted them in mass...never doubt what a mass of angry ppl can achieve.

uh Mike, i was on their website a week after the gun confiscations began or so and i had to look for info on their site about it. It wasnt under major headlines and it wasnt on their main page. In fact, they even said in their post that they heard rumors about it and were looking into it.
I believe you received an email, but i don't think it was sent out when the gun confiscations began or even when the new york times article came out exposing it.

(Fairfax, VA) - Today, the National Rifle Association (NRA) filed a motion in United States District Court for the Eastern District of Louisiana seeking a temporary restraining order to block authorities from confiscating law-abiding citizens' firearms in the aftermath of Hurricane Katrina.



"New Orleans is the first city in the United States to forcibly disarm peaceable law-abiding citizens and it must be the last. Victims are dealing with a complete breakdown of government. At a time when 911 is non-operational and law enforcement cannot respond immediately to calls for help, people have only the Second Amendment to protect themselves, their loved ones and their property," said NRA Executive Vice President Wayne LaPierre.



"The NRA stands with law-abiding Americans, who agree that at their most vulnerable moment, their right to defend themselves and their families should not be taken away," said Chris W. Cox, NRA's chief lobbyist.



According to The New York Times, the New Orleans superintendent of police directed that no civilians in New Orleans will be allowed to have guns and that "only law enforcement are allowed to have weapons." ABC News quoted New Orleans' deputy police chief, saying, "No one will be able to be armed. We are going to take all the weapons."



"The NRA is determined to stop this blatant abuse of power by local politicians. It is disgraceful that any government official would further endanger the lives of innocent victims by issuing this ridiculous order. We are very grateful to the many rank and file police officers who have come forward and assisted NRA in exposing these violations of constitutional freedoms. We are also pleased that the Second Amendment Foundation is joining us in this effort," added Cox.



"The actions of the New Orleans government have destroyed the one levee that stands between law-abiding citizens and anarchy - the Right to Keep and Bear Arms. The NRA will not rest until this injustice is resolved," concluded LaPierre.

Numerous media sources are reporting on a campaign by New Orleans city authorities to confiscate lawfully-owned firearms from people in the city. Louisiana statute does grant the government, during a state of emergency, broad powers in regulating and controlling firearms.

However, we have seen not just with Hurricane Katrina, but other similar situations, that when police are unable to control the criminal element, people turn to the one freedom that protects all others--the Second Amendment.

While one can certainly understand the dire predicaments of all those affected by Hurricane Katrina, as we have learned throughout history, campaigns to disarm the lawful do nothing to disarm the criminal. And in truth, these restrictions make citizens less safe. Despite the valiant efforts of many law enforcement officers and rescue workers, too many of those left in the wake of Katrina are ultimately responsible for their own security and safety and that of their families and loved ones. This is especially true when communication is virtually non-existent and police can't be quickly summoned to respond to calls for help. At these times, lawful gun ownership is paramount to personal safety.

Of course, the entire situation in New Orleans is constantly in flux. But rest assured NRA is monitoring this situation very closely and will address any activity by the government that unduly infringes upon the rights of lawful gun owners at the appropriate time. As we learn more, we will report to our members accordingly. In the interim, however, we join with all Americans in offering our thoughts, prayers, and assistance to the victims and survivors of this terrible natural disaster.

On Monday, NRA Executive Vice President Wayne LaPierre, and NRA-ILA Executive Director Chris W. Cox slammed New Orleans authorities for this incredible action.

?What we?ve seen in Louisiana-the breakdown of law and order in the aftermath of disaster-is exactly the kind of situation where the Second Amendment was intended to allow citizens to protect themselves, ? LaPierre said. ?For state, local, or federal government to disarm these good people in their own homes using the threat of imminent deadly force, is unthinkable.?

?The NRA will not stand by while guns are confiscated from law-abiding people who?re trying to defend themselves,? Cox said. ?We?re exploring every legal option available to protect the rights of lawful people in New Orleans.?

To that end, NRA has put professional investigators to work on the ground in New Orleans and surrounding areas. News stories and members? detailed accounts have been followed up on, but we need more information. Some of our best leads have come from rank and file law enforcement, but we need to hear from all directly affected citizens.


Ok, it does say that wayne and another slammed somebody for these actions on monday...not sure but i guess slammed means told them what for with no media coverage? Seems the ppl from the NRA could have gotten ome media coverage if they had wanted it...couldnt they.

Anyways, i dont wanna argue about it. I have my reasons to doubt the nra in the past 4 or 5 years. But they did good hear in the end so cool.

THE PEOPLE'S SECTION

As we prepare to celebrate "Constitution Week" (Sept. 17-23), it is important that we keep foremost in our minds the document that governs our great land and makes us unique--the Constitution, and specifically, its Bill of Rights.

Everything we at NRA-ILA do is governed by an unwavering commitment to the Constitution and its Second Amendment guarantee to bear arms. Sadly, however, not only is the Second Amendment constantly under attack, but so too are other integral parts of this work of genius. Sometimes attacks are obvious, like licensing, registration, and gun bans. Sometimes they are more subtle, promoted under the guise of innocuous sounding laws like campaign finance "reform." Whatever, their form, however, they are all destructive, and must always be met with active resistance.

In particular, the Bill of Rights, which enshrines, among other freedoms, our Right to Keep and Bear Arms, should be viewed as "The People's Section" of the Constitution. Unlike Articles I-III, which lay out the requirements and powers of the Legislative, Executive, and Judicial Branches, the Bill of Rights designates no powers to the government. In fact, it does quite the opposite. The Bill of Rights restricts government encroachment on the rights on those it governs; on "we the people."

Look at some of the verbiage in the Bill of Rights: "Congress shall make no law..." (First Amendment; "...shall not be infringed." (Second Amendment); "...shall not be violated..." (Fourth Amendment); "...shall not be construed to deny..." (Ninth Amendment). These phrases protect the people; they don't empower the government. In a way, the Bill of Rights is where we the people get to say "no" to the government.

Governments have powers. People have rights. Thus, the Second Amendment does not guarantee a privilege granted by the government to keep and bear arms. It explicitly guarantees the right of the people to do so.

Politicians must remember that they can't carve out sections of the Constitution and Bill of Rights they don't like, and profess support for the undivided document. You either support the Constitution and Bill of Rights, or you don't. There are too many Chuck Schumers, Hillary Clintons, and Dianne Feinsteins who constantly work to set aside the Second Amendment (and, in the case of campaign finance "reform," the First), while they profess to be upholding their sworn oaths to protect the entire Constitution.

We are blessed to have been given our freedom by our Creator and our system of government by great, brave men. However, it is up to each of us to ensure we keep it, and that the system works, by actively participating and speaking to others. Still today, the price of freedom truly is eternal vigilance.

Celebrate "Constitution Week" and honor this great document by actively doing even just a little something to uphold the ideals set forth in this great charter. Talk to someone about the importance of the Second Amendment; contact your U.S. Representative in support of S. 397, as passed by the Senate; encourage your lawmakers to support H.R. 1288/S. 1082 (D.C. gun ban repeal); register a new pro-gun voter; recruit a new NRA-ILA FrontLinesT Volunteer; or write a letter to the editor. These steps, though sounding small in scope, serve as great homages to our nation's governing document and its principles, and are a phenomenal way to not only strengthen our Second Amendment rights, but to also educate others on the significance of the Constitution and Bill of Rights.

Regardless of when they acted, it was NRA that filed the suit... they were the first to actually do something about the situation, and they were successful in their efforts...

Regardless, the waited almost 2 weeks to file the motion. New York times did story on the 8th of Sepember regarding the gun confiscations.

They did the right thing...albeit a little late maybe.

they had the matter under investigation before the 16th... more info was needed... i say the NRA acted responsibly, and their actions were quite timely...

What about the president bush and fEma? You probably know that when FEMA is in an area as New Orleans they can call the shots as the feds can do. What do you think about the fact that our great republican president didnt try to stop this?
What do you think about bill oreilly or any another so called independent news puds NOT talking about this?

i think our republican president was the one who came up with the idea...

a lot of people have the misconception that NRA is a republican organisation... they are not... NRA is a political opportunist, they will support any candidate that promises to fight for the rights of gun owners...

republicans as of late have been very eager to get NRA's endorsement, so they do things to appease NRA, which earns them NRA's endorsement... democrats as of late have sought to appease those who have embraced gun control as a means of reducing crime, so they tend not to get NRA endorsements
