My dad said you used to be able to order 100 lb. sacks of peyote buttons from Texas... Is this true? He claims to have ordered a bag, syaing, no one knew what it was back then.

peyote, no. San pedro, peruvian torch, other legal psychoactive cacti, yes. Peyote is ILLEGAL, has been for a long time, and probably will remain so for a long time. Anyone telling you they have legal peyote is either pushing one of the above mentioned cacti, or is just full of shit.

King of a strange outcome with the Native Americans- We destroy their civilization, and they get mescaline and gambling. I wonder if it's legal to trip in a casino if you're Native American?

in response to the _life_ magazine article by wasson about the visions from the mushrooms of mexico (maybe 1956? it's at erowid or the psychedelic library or the lycaeum someplace), a reader responded in the next issue about his "visions" from ordering & consuming bulk dried peyote cactus buttons from texas...
apparently this country didn't start going bonkers about psychedelics until the johnson & nixon era (mid-60s to mid 70s & beyond right up to "now", mmm?)

you can go to certain states and do it legally with the Native American Church, though they still may feel like fucking you over if you're white or non Native-American and partake in their ceremonies. (not too likely, but if you buy some from them, possibly)

Lophophora Diffusa is legal in the U.S. and I'm pretty sure it contains some mescaline. Although I heard it doesn't compare to Lophophora Williamsii which is the one that is the most peyote-ish. Probably like the difference in hash and standard bud.

if anyone knows of any resources on how to join the native american church, i'd like to know.

i know i can use peyote where i live if i join their ceremonies, but i haven't been able to find them (i could a while back when i looked but now searches are turning up blanks) and i'm also not sure of membership requirements.

i'd really like to attend and be in the presence of serious shamans.... that would be something else.

I've found San Pedro at Target , Home Depot, etc...
Don't bother calling the stores, cuz they aren't always labeled, and the "associate" at Target doesn't know what a San Pedro looks like.

How would someone ID a pedro/torch cactus at a home depot? Is there certain things to look for? When I look at cactus in retail sources they all look the same to me.

My family is Native American, I had an uncle who was not. He married my aunt who lived in Reno, Nevada with dubious intentions. He was very new agey and fancied himself a reincarnate of an old indian or some such nonsense... In any case he apparently joined the native american church recently but only after a lengthy process first with the church officals, then with local government (of which-ever state he resided in at the time) and finally the federal government.

It's told by my grandmother that a large portion of some NACs are mostly white, new agey ex hippies and this is what brings alot of the derision to the church. I believe the requirement for acceptance is only a 10% lineage on either side of the family but don't quote me on that, the gov't has changed this in the recent past either to or from this number.

This is the only person I know involved in this activity and I'm sorry to say I do not look favorably upon him for it. This church is a way for the south western tribes, and evidently alot of other north american tribes to reclaim a culture and belief system that was outlawed and subsequently lost to time because of western expansion and colonialism. It's something new, and in my opinion down a few notches from the origonal belief systems of plant/animal shamanism and earth worship (and in some people's views a scam as well as a heracy to their people's history...), as well as a way for these people to overcome the alcoholism that plagues them in huge numbers.

Say what you will about the abandonment of white people by archetypal earth worship/paganism/wholistic spirituality but there are a ton of other just as reputable outlets for them all over the world to attach themselves to... Although yes it can be said that europeans lost pagan culture to the expansion of christianity but at least aspects of that religion were absorbed and intergrated instead of being completely wiped from the cultural memory...

I'm drunk on sleeplessness.

EDIT: I do not neccessarily disagree with non indian people joing the NAC, these are just some passing thoughts as well as my small experience with the topic.

And yes it certainly would be awesome to witness one of their peyote ceremonies.

Q: Is peyote legal in Canada? I saw that its got a special exemption from your peyote law page, but I was confused.
A: The controlled drugs & substances act (CDSA) can be found (march 2001) at:

In the current CDSA it appears that peyote is -specifically- exempted from the law, which means it is definitely not a schedule III substance, although extracting the chemical Mescaline from it would likely result in a schedule III drug. This wording leaves open (to me) whether a tea made from peyote would be illegal to possess and it seems like there's a grey area if you had peyote ground up or otherwise prepared for ingestion.

"17. Mescaline (3,4,5--trimethoxybenzeneethanamine) and any salt thereof, but not peyote (lophophora)"

Interestingly, Canadian law chooses to exempt the entire genus in which there are several other plants other than the classic peyote.

As to exactly how that law is enforced would depend entirely on the cases which have gone to court and been prosecuted. What judges and juries have decided would set the tone for how broad the peyote exception is. I would imagine there are very very few cases of peyote prosecution because it just doesn't grow in canada and is a difficult cultivar. In the US there are very few peyote cases we know of.

I did a broader search on canadian law and found no other references to peyote or its technical genus "Lophophora" or its species "williamsii". This suggests to me that it is not a federal canadian criminal offense to possess or grow peyote for personal use. I have no idea how sales are regulated in canada, but I would tend to suspect one would get hassled if you're caught selling it prepared for ingestion.

The next question that needs to be addressed is what province you're in. In the US, every state has its own set of laws which add to the federal laws. I think its the same in Canada, so we need to check the statutes of each province to see what they say. I went through all of the provincial statutes that i could get online (most provinces) and found no drug laws specific to any province -at all-. It could very well be in canada that they have decided to consolidate the drug laws into one place, the federal canadian system. I imagine this would save the US enormous amounts of money if it did this. Originally the US didn't do this because it was seen as unconstitutional, it was only in the 1960s when the US Congress decided it had the power to do so and began making possession of substances per-se illegal.

If peyote is prepared for ingestion or extracted in some way, it will likely be treated as a controlled source of mescaline, as in other countries.

There is also the possibility that individual cities or counties have drug laws, but I don't know how to answer that. I believe that Canada's drug regulations are almost entirely country-wide and individual provinces do not have their own psychoactive drug control laws. Perhaps someone who reads this and is familiar with canadian law can write in with what they know about local level drug laws or jurisdictions.

So, to try to sum up an answer to your question:

It appears that peyote is not illegal in Canada.
