Cannabis Caf? goes to court
The Crown has wrapped up its case against Lynn Wood, a marijuana advocate and the owner of the Cannabis Caf? in Saint John.
Police busted the Cantebury Street caf? in April 2004 for selling marijuana. The Crown is alleging that the caf? sold the marijuana for profit, and that sales were aimed at high school students.
Corporal Steve Gourdeau, an RCMP drug trafficking expert, told the court on Tuesday that he considered the caf? to be a common commercial drug operation.
Police videotaped a 15-year-old high school student going into the caf?, and then huddling with other students on the street corner.
The student testified he went to the Cannabis Caf? almost every day at lunch for five months and bought marijuana for himself and his high school friends. Records show he spent more than $2,000 at the caf? between November 2003 and April 2004.
Saint John police officer Ryan Hutchison testified that the caf? sold over $60,000 worth of marijuana during those five months.
The student claims he was warned by Wood that he should not be re-selling the marijuana, but that she never cut him off.
Defence Lawyer Rick Northrup argued that the caf? was clearly not a regular trafficking operation. He says marijuana was only sold to patrons who swore an oath that they had a medical condition.
Northrup also noted that the drugs sold at the caf? were sold at half the street value of most marijuana and that the bags the drugs were sold in were clearly marked, "not for re-sale."
Northrup indicated he would be calling witnesses who use marijuana for medical purposes during the defence's case, which begins Wednesday afternoon.

what's a 15-year old doing smoking pot everyday and where did he get the money to buy weed on a daily basis? hope this doesn't mess things up for the medical marijuana patients.

This was a cafe in Canada that allowed smoking pot openly, I believe. Too bad they took it one step further and sold it also.

The article seems to be insinuating that he was buying it from the cafe and dealing it, hence giving him the $2000 that he spent on marijuana.
Nonetheless I really don't see any problem with this, I hope the cafe reopens and continues as normal. Canada should legalize it already, instead of wavering on the edge when it's obvious they're going to do it eventually.

SAINT JOHN, N.B. - The owner of the Cannabis Caf? in Saint John has been found guilty of drug trafficking, after a judge rejected the defence that she was running a compassion club.
Owner Lynn Wood had argued that her establishment only sold marijuana to members who needed the drug for medical purposes.
In a written decision on Monday, Judge Murray Cain dismissed the argument as a sham, noting, for example, that the caf? raffled off a bong – a pipe used for smoking marijuana – to mark the end of school.
Courts in Canada have tossed out trafficking charges in several cases where compassion clubs formed to provide medical marijuana to people who had trouble finding it elsewhere.
However, Cain said the Cannabis Caf? didn't live up to guidelines that these clubs set for themselves, such as only selling to members.
The trial heard evidence that it sold marijuana to almost anyone, including a 15-year-old high school student.
The defence had said the Cannabis Caf?'s members were required to produce a doctor's certificate or swear an oath that they had a legitimate medical condition.
The court heard from several people with medical problems who said the quality of their lives had been vastly improved by smoking marijuana from the caf?.
Wood's defence lawyer, Richard Northrup, said his client was disappointed by the ruling.
"What I have to do is look at the judgment and see what the client wants to do," he said.
Wood will be sentenced on May 12.
The Cannabis Caf? remains open but says it has not sold marijuana since the June arrest

SAINT JOHN, N.B. - A pregnant New Brunswick woman convicted of selling marijuana for what she insisted were medicinal purposes will have to deliver her baby in jail.
Lynn Wood, 32, owner of the Cannabis Cafe in Saint John, N.B., was sentenced to one year in jail on Wednesday for trafficking in marijuana in a case that raised questions about the sale of pot to people who say it eases their pain and suffering.
Wood defended her cafe as a compassion club where people who wanted to purchase marijuana had to prove to her that they needed it for medicinal purposes.
But Provincial Court Judge Murray Cain did not buy the compassion club argument and convicted Wood of trafficking in February.
Wood's lawyer, Richard Northrup, had earlier asked the court to consider house arrest so that Wood could deliver her baby at home.
But Cain said she posed a high risk for re-offending. He said Wood will have the medical attention she needs to deliver the baby in jail.
Wood was first arrested on April 23, 2004 after selling pot to an undercover police office. On June 3, 2004 police again found her selling to customers a few doors away from her store.
Prosecutor Nicole Poirier asked for jail time because the Cannabis Cafe was located on a street used by high school students every day. She said the cafe even had a graduation promotion offering drug-smoking equipment as a prize.
Northrup said Wood is under psychiatric care as a result of her conviction and cries all the time.
Canadian courts have stopped trafficking charges in at least two cases where clubs were formed to provide medical marijuana to people who had difficulty getting the drug from other sources.
Those clubs were solely in the business of providing marijuana to people with illnesses.
Wood said she asked her customers for a doctor's note or a sworn affidavit stating that the marijuana was needed for medicinal purposes.

Ms. Wood, owner of the now-closed Cannabis Caf? in Saint John, was led into a Fredericton courtroom in leg shackles on Tuesday as she appeared for an appeal of her one-year conviction for trafficking in marijuana.
Following her was her husband, Jim Wood, carrying their one-month old baby, Jimmy, in an infant carrier.
The judges gave Ms. Wood a four-month extension on her bail, so she is free at least until January, when the Court of Appeal will hear arguments against her conviction and sentence.
Ms. Wood, the mother of four children, has maintained that the Cannabis Caf? she operated was a compassion club offering only medicinal marijuana.
A provincial court judge disagreed, noting that other drug-related items were sold on the premises, such as pipes and drinks meant to mask the drug's effects.

She's going to jail, and as much as i hate to say it, she asked for it. Located near a high school? Raffle to commemorate graduation, including what the U.S. and others call paraphenalia? Some 15 YEAR OLD buys 2 GRAND worth of pot in less than a year????

I was smoking pot every day back when I was 15-16 so that's not too surprising. Especially since that's here in BC. And the reason he probably bought so much is he was going to the store for everybody in his circle, buying what they were going to smoke and probably some private stashes too. It only takes a bit over $5 (1 joint) per day to reach $2000 in a year.
There was also Dakine Cafe which was openly selling marijuana in Vancouver last year, maybe this person was trying to follow in their footsteps? Dakine WAS hoping to have the cafes openly selling pot spread across Canada.
