Chief Justice Dies: Bush's court now?
    #4617751 - 09/03/05 09:43 PM (18 years, 7 months ago)

Well, the Chief Justice of the American Supreme court died today, meaning Bush will have to appoint another Supreme Court Nominee. When is the last time a president has appointed 2 justices?? The entire board will have a conventional mindset... not my ideal situation. This president has had so many influential and historic events happen to him... he'll probably be remembered for that... although he'll probably go down for bumbling up all the situations too.

Time for HR: 1528 to be made law very soon.

He was a great man. We have lost two of the three justices that voted for medical maryjane. I would expect more sympathy from this forum. I often wonder how some of you arrive at your misguided ideologies.

And if I remember correctly, two judges who voted against the eminent domain case.

Also, this vacancy is not nearly as important as O'Connor's. While filling in a new conservative judge for a conservative vacancy is not a big deal (Rehnquist), filling in one of the most unpredictable swing-voter in recent history (O'Connor) is much more important to the future of the court.

RIP Rehnquist. I may not have agreed with all of your decisions, but you made your opinions based on the law.

What I was hoping was for the judges to fall off the bench perhaps during the next precedency, hopefully someone liberal who'll get a swing vote for some change... Not for another 20 years now...

Hopefully Bush will choose someone who can read the words of the constitution and not see things that are not there.

--------------------
You cannot legislate the poor into prosperity by legislating the wealthy out of prosperity. What one person receives without working for another person must work for without receiving. The government cannot give to anybody anything that the government does not first take from somebody else. When half of the people get the idea that they do not have to work because the other half is going to take care of them and when the other half gets the idea that it does no good to work because somebody else is going to get what they work for that my dear friend is the beginning of the end of any nation. You cannot multiply wealth by dividing it. ~ Adrian Rogers

Rehnquist is a conservative. If Bush replaces him with another conservative, it's still 'balanced'. The O'conner replacement is the one that will have an effect.

True, but I was expecting Rehnquist to go later, leaving room for an unbalance toward liberalism.... well either way, I'm not very politial and the lines between whats legal and illegal don't really exist for me

What exactly is a correct decision? Correct in public opinion, correct in your personal views, your towns? I personally believe that they have the toughest jobs in america... but it's one I would be willing to fill. I may not be able to make all the 'correct' decisions but I'd make the one's i believed in. I guess thats all you can ask from a Justice, to pick one with high moral regard and principles and let him choose the law, instead of picking someone on what you think his opinions on certain subjects will be.

Correct based on what the constitution reads.

In the past year, they have fucked one up on medicinal marijuana and one on eminent domain. These were major fuck-ups. Me, being a 3rd year Con-Law/Political Science student could have put together a better decision than them.

I believe in the constitution but it has it's limits. It was near flawless when it was written, the amendments helped, but there are situations and activities in our society today that are completely beyond anything that the consitution could have planned for... I have no solution for this, I didn't know where I planned to go with this post

Eminent Domain

Medicinal Marijuana

Read those two short articles, and then tell me whether they ruled correctly. I bet you'll agree with me that they didn't.

Oh I've read them before and i certainly agree that the wrong call was made... law is not my forte', (however spelled) I'm an engineering/science major, so for me, the laws laid out ahead of me are absolute with very little room for interpretation. I guess I'll have to trust in wiser people elected to positions to do my law making for me... however little satisfaction comes from that, and I'm sure you'll agree to that.

WE need some more Clarence Thomsas! That guy actually realizes that the government is supposed to respect individual liberties. I think there is a good chance that Bush's picks will be better than Clinton's. Hopefully.

Anyway's if you read up you will see that the 'conservative' judges have been far kinder to civil liberties and medical marijuana than the liberal ones. Trust judges who believe the constitution is about liberty, not those who think it is a 'living document' amendable to any political fashion.

A smart move.

Sandra Day O'Connor promised she would stay on until her replacement was confirmed. By appointing Roberts Chief Justice rather than just making him the replacement for O'Connor, the full slate of nine justices will be available when the court resumes.

Besides, there is little serious opposition to Roberts. He's a certainty to be confirmed. Might as well plunk him into the more contentious position. The Dems will howl much louder at whomever the next proposed appointee will be.

That's an interesting arabesque. I have a more likely one. Elevate Scalia, replace Rhenquist with Roberts and ask O'Connor to stay to replace her with one of the women. Rhenquist was an asshole for staying on too long as it was. The guy was fucking shot at the swearing in. Three hearings, one for Scalia, one for Roberts and one to replace O'Connor. The fucking Dems will be spinning so hard they won't know where to turn to bite next.
