Is this fair?
    #4597917 - 08/30/05 04:27 AM (11 years, 3 months ago)

Ok, so back in March I got my second MIP (Minor In Possession of alcohol), please spare me the "you are dumb, be more careful" remarks, both were very unlucky situations that could have happened to almost anybody. Anyways, I was sentenced last Friday by a judge that is notoriously hard on alcohol offensives due to the fact that her son was killed by a drunk driver. Tell me, is this justice.....?

-9 months probation (that's right, no pot for 9 FUCKING months)

-2 AA meetings a week for the entire 9 months

-3 drug/alcohol meetings a week for 6 weeks, "intensive outpatient therapy" 2 hours long each session.

-1 "Victims of alcohol" meeting per month

-300$ fine

And just in case you didn't know, probation officers can enter your residence at ANY time un-announced and search your place WITHOUT a warrant. So basically I have 0 rights, I can't do anything. And get this, I am not allowed to drink alcohol on probation, not even when I turn 21 in December, what the FUCK? And I am not allowed to associate with anyone with a criminal record. I do realize that I broke the law, but jesus fucking christ, fuck this bullshit. I am not a drug addict, I am not and alcoholic, I just don't need this SHIT. I am working and about to start going back to college, this is so horrible.

When I got busted for MIP, it seemed pretty unfair. Luckily, this was my first offense for it.

- 12 months unsupervised probation.

- $300 fine.

- 48 hours of community service. (This was 48 hours in the southern, summer sun at a Landfill. One of the most horrible times I've ever had.)

Just for drinking a beer? Little rough...

But yea, your's is a hell of a lot worse than mine was.

Good luck with it all.

I find it interesting the way different cities/counties/towns etc. have different penalties.

When I was in college it was a $50 ticket each time. Show up to court and say: "I'm very sorry your honor" pay your money, do not pass "go" and move along.

Sounds like you guys got a pretty stiff sentence.

what you should have said to the judge:

"i do realize that I broke the law, but jesus fucking christ, fuck this bullshit. I am not a drug addict, I am not and alcoholic, I just don't need this SHIT. I am working and about to start going back to college, this is fucked up, fuck the law, fuck this court & fuck you, you fucking nazi bitch"

I'm very sorry to hear that. I don't know what the hell I'd do for 9 months without any alcohol or illicit substances. Probably invest in OTC or the more natural psychedelics. And no, it's not fair. It's bullshit. If you had the money to afford a high priced lawyer, you would have not even been found guilty, or had to plead guilty.

My friend got out of going to AA meetings when he got arrested because they were all held in churches and preached many christian beliefs. So he brought up that fact to his probation officer and said he refused to go to an essentially christian program because of his beliefs and if they forced him he would file a lawsuit. He didn't have to go a single meeting. You might want to try that, it will at least make it a little more bearable. If they still require you to you could contact the ACLU and see if you have a solid case and could get a pro bono lawyer for some legal action.

I got an underage consumption charge shortly after I turned 18. I don't know if that's the same thing as a MIP or not but all I had to do was pay court fees and go to one meeting where I watched a video about a guy binge drinking and killing himself. After that, I was done. No community service, probation, anything. Sorry to hear about your situation. :frown:

I was supposed to go to AA for my probation and got out by telling my PO I pissed everyone off at the first meeting by telling them that I don't believe in God and prayer, and saying How I don't want to quit drinking and it is a court ordered sentence that when fufilled will be rewarded with a bunch of cold Sammy Smiths and a big joint. I said I'm sorry but I don't lie to myself or to others, it would be a waste of time to myself and nonproductive to those who are there to better themselves voulantarily.
It worked.
