http://www.famm.org/si_federal_sentencing_sensenbrenner05.htm
Quote:

Sec. 425 of Part D of the Controlled Substances Act: Failure to protect children from drug
trafficking activities (new section) (Sec. 2(m))
? Creates a new offense for persons who witness or learn about a variety of drug
trafficking activities and do not report it to authorities within 24 hours and do not provide
full assistance investigating, apprehending, and prosecuting the offender
o Triggering offenses include:
􀂃 Maintaining drug-involved premises affecting children
􀂃 Endangering human life while illegally manufacturing controlled
substance
􀂃 Distribution to persons under 21
􀂃 Distribution or manufacturing in or near schools or colleges
􀂃 Attempt and conspiracy relating to employment or use of persons under 18
years of age in drug operations
􀂃 Drug trafficking in the presence of children
􀂃 Drug offenses near drug treatment facilities or targeting persons in drug
treatment
? Adds new 2-year mandatory minimum for individuals and 3-year mandatory minimum
for parents, guardians, or persons responsible for the care or supervision of minors who
violate this provision; 10-year max for both

Nothing is happening to it so far, at least as far as I can tell, but now is the time to write your representatives about your oppositions.

Apr 21, 2005: Referred to the Subcommittee on Health, for a period to be subsequently determined by the Chairman.

http://www.govtrack.us/congress/billtext.xpd?bill=h109-1528

however futile it is, it's good to write your representatives about it while you still can... they might lightly consider your opinion.

I actually don't think this will pass.... it seems like we're going to go full out nazi on terrorism while relaxing drug crimes a little bit..... and based upon my reading skills it sounds like this only applies to if you know about MINORS using drugs.... so... it's bad news for parents and children, but not the casual user quite so much... but it's still fascist as hell and should not be tolerated.

Not only minors at all! This bill is the worst piece of legislation ever created. Keep reading if you got to the minors part and stopped. It gets much, much worse.

i can't really make heads or tails of all the bullshit and legal dribble.

" Any person who violates subsection (a) of this
12 section, knowing that the manufacture, distribution, stor-
13 age, or use of any controlled substance involves or is in-
14 tended to involve a person under the age of 18 or an in-
15 competent person, shall be fined not more than
16 $2,000,000 (if the offender is an individual) and not more
17 than $8,000,000 (if the offender is an organization) and
18 imprisoned not less than 5 years or more than life, and
19 if the defendant is the parent or guardian or otherwise
20 responsible for the care or supervision of such person shall
21 be fined as provided in this paragraph and imprisoned not
22 less than ten years or more than life.''."

for example this is extremely fucked up but it does not mention what the crimes its referring to are.

http://actioncenter.drugpolicy.org/action/wacmoreinfo.asp?item=26179

this is a decent summary.

--Makes it a federal crime to provide "drug paraphernalia" to anyone. While the goal is to make it a crime - punishable by up to three years in prison - to give someone a bong as a birthday present, it would also make it a federal crime to provide someone with sterile syringes (except where it is explicitly authorized by local or state law). If enacted, it would essentially criminalize many needle exchange programs.

--Mandates a 5-year minimum sentence for any person that commits a drug trafficking offense near the presence of a person under 18 or in a place where such person resides for any period of time. The sentence is 10 years if they are parent. (I.e. a mother that sells her neighbor a joint will get a 10-year minimum sentence, even if her kids were at school at the time).

The US Government, protecting families by tearing them apart.

This is another law that makes simply knowing about drug use without snitching, legally worse than murder and rape.
