Syringes and spores

There's all this talk trying to comfort people about how spores are completely legal (with the exception of CA), and how it's completely legal to possess a syringe with or without spores. If this syringe was found, wouldn't it be considered paraphernalia, and grounds for a search warrant for your house? If there were spores in it, wouldn't it be considered intent to cultivate illegal narcotics?

Conspiracy right? I wonder if someone can tell from a spore and only a spore what type of mushroom it came from and will grow.
What it all comes down to though is how much money you have and how good your lawer is. The system sucks!
