An 11-year-old girl who threw a stone at a group of boys pelting her with water balloons is being prosecuted on serious assault charges in California.

Maribel Cuevas was arrested in April in a police operation which involved three police cars and a helicopter.

She has since spent five days in detention, in which she was granted one 30 minute visit by her parents, and has spent a month under house arrest.

Her lawyer accuses the authorities of criminalising childhood behaviour.

"They're treating her like a violent parole offender," Richard Beshwate said. "It's not a felony, it's an 11-year-old acting like an 11-year-old."

The girl is due back in court at the beginning of next month.

Police say they had to investigate as the boy who was hit by the stone she threw suffered a deep gash to his head and needed hospital treatment.

He has reportedly acknowledged to officers that he started the fight in late April.

'Obligation'

The confrontation happened in a poor district of Fresno, in central California, where Maribel Cuevas lives with her Spanish-speaking family.

The girl, who speaks little English, has admitted throwing a stone at a group of boys she says were pestering her with water balloons as she walked down the street.

An ambulance was called, but arrived flanked by three police patrol vehicles. A helicopter meanwhile hovered overhead.

The 11-year-old was then read her rights twice in English before being detained.

"We responded. We determined a felony assault had taken place and the officers took the actions that were necessary," said Fresno Police Sergeant Anthony Martinez.

Another police officer told ABC News that the girl, when asked what she thought would happen if she threw the stone, replied that it would make him "bleed".

Stuff like this is one reason I hate when people talk about how California is so much greater than every other state. I grew up there, and even though I love alot of things about the state, its crazy how most people and groups over react there. They blow alot of things out of proportion, and then when people stop and look at the situation in hindsight, and realize how out of hand its become, its already too late to calm the situation. Then the reaction has its own inertia, so to speak, and nothing can be done to stop it.

Its been here for a long time. We've all just been SUPER conditioned to accept it.

For instance, the amount of people that will stay at intersections at 3 in the morning with red lights for like 10 min because some computer automation told them to. Even when they can see that there is NO ONE coming though the intersection for MILES. Even when there is no headlights around that could be cops. Same thing with walking though street intersections. There seems to be two kinds, the smart ones that go though, and the ones that like the system so much they will accept a timer over USING THERE BRAIN.

I never realized how much conditioning went on till I turned off my T.V. 4 or 5 years ago. It never got turned back on, and the longer it stays off the more I learn about how conditioned people are.

Childhood was outlawed a longgg time ago. Take under-age drinking. There have been boys drinking booze behind barns ever since there have been boys, booze, and barns. Whats the point of making it a criminal action?

Haha.  Have you seen a picture of the rock?  On the news they said it was about two pounds and it looked pretty damn big.  I personally don't see how a little girl actually could throw it far enough to hit somone unless the kid that got hit was like 3 steps away.  I think the kid deserved it for 1)starting the whole thing 2) for not knowing better to dodge a big rock coming at his head 3) for being a little bitch that got owned by a girl .  Hes never gonna live it down.

I wouldn't be supprised at all if one of the kids she threw the stone at had a lawyer as a parent. This has lawyer parent written all over it.

When I was 8 the girl who lived next door to me threw a stick and hit me in the eye. I did nothing to deserve it and I had to wear an eye patch for a month. We didn't sue. We didn't call the cops. That kind of shit happens when you are kids. It should be expected. All my parents did was tell her parents what happened.

Whatever you call it: the taxpayers lost $10.000, the girl is traumatized, even the kid who got hit by the rock likely discovered that danger and insanity wears badges and guns nowadays, everyone who has doubt about the gov't is going "just typical!" and the man in the street has more proof that the country went down the tube. The Police department must be greatly embarassed and severely lost credibility.
All have lost.
