Could I, or any other person, bring a class action lawsuit against the Department of Justice in regards to marijuana laws?

Because they have already ruled in the Supreme Court that the drug laws are constitutional.

The laws against the possession, consumption, and/or sale of liquor were once constitutional.

Just because the Supreme Court ruled anti-marijuana laws are constitutional doesn't mean I can't challenge their opinion. I would like to bring a class action lawsuit, on behalf of any American person affected by the war on drugs, against the Department of Justice. It will prove to the American people that their way of handling drugs is not only costly, ineffective, and highly damaging, it is also unconstitutional.

I would love to finally see them pricks who keep the "war on drugs" going get what they deserve. Hell, I'd love just one little set back for the bastards. But I think they have a pretty firm grip, it will be VERY hard to pry some fingers loose. Through the courts or otherwise. And by hard I mean it would take LOTS and LOTS of money lol.

Yes, you can sue the DoJ. You have the right to petition the government for redress of grievances. The case could likely be tossed out of court because the court may come to the conclusion that your grievances may be somewhat imagined.

The most recent supreme court case, Raich v Ashcroft. Raich and Monson sued the DoJ and were granted an injunction by the 9th Circuit Court against the DoJ. The injunction barred their arrest by the feddies for violated the Controlled Substances Act.
