Driving impared questions

I have to drive tonight after a party. I am sure that I will be down for atleast 2 or so hours before i leave. I dont suggest driving impared, but I will not leave unless I am completely sober. This is still not the greatest idea in my book, but not because of my driving ability.

What I am worried about is that at 3-4am cops like to pick random people and pull them over. I do not want to be one of them, I will be driving a pretty normal car, nothing that stands out. I am just worried of my eyes being big at that time.

What can a cop do at this point? Whether im on drugs or not, im gonna be sweaty and look pretty beat from the long night out. In florida or the US, can they request a blood test or urinalysis?

I would obviously pass a beathelizer, but would come up in blood/urine screen.

Do they have the right to this test?

I am sure its no big deal, but i would rather know my rights and prepare ahead of time.

I am only going 7 miles, but 2 are downtown, 4 highway, and 1 right next to the college. So I am sure ill run past a few coppers, especially being on a long weekend.


Any information would be appreciated.

The cops WILL be out in force, this being a holiday, so I can understand your concerns. If you're going to be sober, I don't think you'll have any problems if you're stopped. Of course, they'll be looking for drunk drivers mainly, but if they don't smell alcohol on you, it should be cool. Just try not to act overly nervous or suspicious, and you should be fine....

its easier said than done. I am tough when im on the internet, but im i have a guilty conscience and get pulled over knowing what might happen i cant help but get a little rattled. I hope everythign goes well. Thanks the the reply

Here's an idea: Be mature, and don't do drugs if you are going to be driving. How tough is that?

I had a feeling one of those were on the way.

I understand where you are coming from, but I will not be on drugs at the time. But anyways, what drugs I are or are not taking does not matter.

If a cop sees your pupils are big when they pull you over, and its too late to have "just come back from an eye exam" do they have the right to give you a urinalysis, or blood word because off your physical appearence?

It has always been my experience that with hallucinogens you think you come off a lot more fucked up than you actually seem to straight people. They always have no clue, only other trippers can tell. If you're going to be two hours past down you'll be fine.

If you are this worried about being pulled over, why don't you A) not do drugs tonight (That seems out of the question for you) or B) spend the night at where you will be doing drugs?

I'm pretty damn sure they cant request a UA, or blood test, but even if you were asked too, a normal test that they would give you would not include Psilocybin. But i guess the whole point is that they would give it to you because your pupils would be enormous, so it probably wouldnt be the normal drug test. But to conclude, i really don't think you have anything to worry about, even if you were pulled over, you acted suspicious, they cant do anything, and I would bet my life taht they would not try to get a urine analysis or blood test from you. Don't Worry about it.

Yeah, if you're not fucked up and would pass a breathalyzer (sp?) then you shouldn't have anything to worry about. Plus, there really isn't a great chance that they'll pull you over if you're not speeding or doing anything else illegal. If they do, just be polite and you should be fine.

Pennsylvania has a clause in their motor code that, by accepting your drivers license, you agree to concent to a breath or urine test at police request. If you refuse this, you lose your license for 6 months. The good thing is that you can just refuse is, lose your license, and not have the DUI.

We drove there, were planing on maybe getting a cab home and picking up the car in the morning, but by the time we were ready to leave I was well down from the drugs, and wide awake still, so we drove home.

This is not entirely accurate. You do indeed lose your license for 6 months if you refuse to take a breath test. This does not mean that the police will let you get out of a DUI. I refused to take a breath test and they went and got a warrant to take my blood, they claimed it would be by force if necessary. I got out of the 6 month license suspension on a technicality but I still got charged with DWI.
