SCOTUS closes the internet...
    #4343287 - 06/27/05 01:44 PM (18 years, 9 months ago)

in one of its most pro-fascist decisions to date..the SCOTUS has virtually handed the internet to the big media conglomerates ..

http://caselaw.lp.findlaw.com/scripts/getcase.pl?court=US&vol=000&invol=04-277

this means that the cable companies have unlimited power to push prices.. block content.. and practice discriminatory pricing (ie charge the shroomery more than jim dobson for the same service)...it also means that most smaller ISPs will be forced out of business.. let alone the website operators that are censored or priced off the web...you can call it the "fair and balanced" treatment for the internet...i happen to be using one of those cable companies at this moment.. and the shroomery is obviously still online..but for how much longer?? (not that i will miss phred&co if it does disappear)...

for the time being..however..most internet users are still on dial-up...neither does the ruling affect DSL or sattelite broadband...so whether and which sites start disappearing depends on how many non-cable users use such sites...

in conjunction with other recent rulings against medical marijuana and expanding eminent domain..it is clear that even the liberal members of the SCOTUS are upholding a moral hierarchy of haves and have-nots..which means favouring monopoly and authouritarianism over competition and free enterprise...

This ruling says that cable companies provide an 'information service' and not a 'telecommunications service', and are therefore not subject to regulations pertaining to the telecommunications industry. For example, they are not required to open up their infrastructure to competitors, as phone companies are.

Other consequences are less clear; the cable companies may now be responsible for the content they provide access to as well as the delivery of the content. A phone ISP is not liable if you download kiddie porn or copyrighted music using their service. Also, they provide the same access to every site. Cable companies may now be liable for your downloads, and may now be permitted to give content owned by another part of their company priority; for example, it may in the future be quicker to access AOL-supported sites over a Time-Warner cable modem. It is not clear to me that this is actually the case; only internet speculation and wild rumor.

30$ a month for unlimited 6meg down 782K up is "ridiculous"? Welcome to America, pal. If you can do it for 2$ a month, start your own comapny.

You can't in fact start your own cable company. That would mean digging holes and hanging wires, which generally requires approval of the city.

There's only a need for one cable (or phone) infrastructure in a certain area; however, any true monopoly will take your balls along with an arm and a leg for service. Cable does face competition from sattelites and phone companies, but not from other cable companies.

Cable internet is about $40 here (I use the competing DSL, which is not available in all areas of the city). Other places, it can be far more expensive; particularly if you don't care for cable TV service.

Phone companies are required to permit competitors to use their infrastructure; this ruling means that cable opperators can continue to act as a monopoly - only one cable company in any area.

Let me get this straight....
If I use my companies money to purchase goods, hire men to install these goods on land that I'm paying to use, and I don't allow others to use this for free, I'm a "monopoly"? Gee, I sure wish that the government would step in and make more laws!!!!111!!!! LOL

You're a monopoly because likely other cable companies would not be allowed the same permits your were allowed. The government is the one who first allowed the monopoly to exist by giving you exclusive permits. (Unless someone knows of government allowing a competing company to run additional cable lines.)
