Supreme Court Term Limit
    #4342608 - 06/27/05 01:00 PM (12 years, 10 months ago)

In your opinion, what would be the advantages and disadvantages of limiting the term of a supreme court justice?

If you are for limiting the term, what do you feel would be an appropriate tenure? 10 years? 20 years? 30 years?

Advantage: Makes the system more democratic and can make it possible to get rid of a judge who doesn't due his or her job correctly (see: all liberal judges on the Supreme Court).

Disadvantage: Would create more partisan judges (as if that's possible). Would also lead to the courts worrying more about public opinion and could lead to the lobbying of the court.

Indeed, probably the main reason we don't have elections and term limits for the justices. They're supposed to be objective (hah!) and follow the Constitution without worrying about the popularity of their decisions.

Sadly, most of them don't as shown by their recent decisions.

I wish Supreme Court nominees were selected by the states instead of by the Senate. Hopefully then they'd have more of a state's rights bias.

They're selected by the President and then approved by the Senate (or not). He can also install judges when the Senate is not in session and then they would have to be voted out (although I'm not sure he can do this with a Supreme).

I think limiting the term would be a great idea, as far as term lengths go I'd say no more than 10 years.

I think we should have a limit. This would get someone in office with a more modern understanding of society and current culture, rather than those eighty year olds who still think this is the fifties.

Term limits are good for any office, from the mayor of a small town to the president of the USA. People shouldn't be allowed to make a career out of a political office. It will most likely lead to corruption and/or poor decision making.

I think if you impose term limits on judges, they shouldn't be up for re-election(or renomination as it were). A judge who has to worry about getting re-elected is going to be a slave to popular opinion rather than enforcing the Constitution.
