I have a newly hired employee(almost 2 months)
he doesn't follow direction well and seems its always someone elses fault.
Yesterday he called one of my other employees racist and an argument ensued.
I have had 2 sit down talks with this employee about being a team player and diong what he is told.
now hes throwing the race card around....I am going to let him go Monday...anyone see any issues if you were him?

Hey Goob, When you fire him PLEASE have witnesses in the room with you. This is so he cannot claim something else was said. If he is already playing the race card God only knows what he will accuse you of... Ya know what I mean?!
Good luck

I had a simular situation when I was in management.
I had a guy throw the race card out...when he was fired.
He was our parts runner.
I fired him for being drunk twice (I had to send him home)...and for selling take out bbq out of the company van at the local shipyard on company time.
The union backed me on his termination...plus the fact that our company had alot of minorities that worked for us.
I'm glad I don't have to deal with this kind of crap anymore!~ Being retired is great!~
My advice bro...
get him on something that he can't use the trump(race) card on you for.
you don't want to have any legal problems over this!~
take care and good luck!~

No problem with it. He's newly hired, doesn't seem to be a good worker, and starts arguments with co-workers. You've already had 2 sit downs with him, so Monday when you fire him would be the third(strike), I dislike the baseball strike reference myself but that's how it seems to go. Fire him. He doesn't sound like he's going to help your business profit.

Make it plain and simple, clear and direct.
You hired him under a contract, which he signed.. And under violation[s] of the contract, is the ground for termination.
It is a matter of a disruptance in work environment, which is a liability to your business.
You should point out that you've already been lenient for him [giving him two chances already] to which he took no heed, as evidenced by the fact that he has exhibited no rectification respective to the situation of disorderly conduct.
As there are plenty of other people waiting in line for employment, to put bread and water on their tables for their wives and children.. you see no reason why he should have any more clout than those men who will be assets to your company, and not liabilities.
Therefore, he can go work for someone who will put up with Grade A Bullshit, because that's one thing the Goobs does NOT take in his business.

I agree. I'd have someone be witness to it.

And might as well elect your lawyer for the witness, of all people, who of course, would be the ideal legal consultant on the side.

Document everything in detail. If this comes back to haunt you, documentation will be your best defense.
