I sat down today and watched Fox News for five minutes. I'm not proud of it, but they were talking about this story.

Gerardo Flores received an automatic life sentence because prosecutors did not seek the death penalty, which was available under the state's 2003 fetus protection law.
Erica Basoria, 17, acknowledged asking Flores to help end her pregnancy; she could not be prosecuted because of her legal right to abortion.
The defence contended that Basoria punched herself while Flores was stepping on her, making it impossible to tell who caused the miscarriage.
Basoria told authorities that, after about four months of pregnancy, she regretted not getting an abortion and started jogging and hitting herself to induce a miscarriage. When her efforts failed, she said she asked her boyfriend to help.
Flores did not testify, but earlier told police that he stepped on Basoria's stomach several times during the week before she miscarried.
Prosecutor Art Bauereiss said most of Basoria's family was pleased with the jury's decision. But Basoria, who sobbed as she left the Angelina County Courthouse, had stood by Flores.
"It's just tragedy all around," said his lawyer, Ryan Deaton.
Texas law defines an embryo or fetus as an "individual" and allows criminal prosecution or civil action for a preventable injury or death of a fetus. The law exempts health-care providers who perform a legal medical procedure, such as an abortion.

I wouldn't stomp on my pregnant girlfriend(if I had one)'s stomach upon her request and the description sounds like consenting BDSM play, but isn't a life sentence a bit...harsh? On Fox News they weren't speaking of how ridiculous the sentence is, but on why he didn't get the death penalty.

So she has a legal right to abort her fetus, but unless the guy who does it has a medical degree...he gets put in jail for life as a "murderer"?
How can we call something a "murder" if we absolve one of the guilty parties of all wrongdoing?

how can we call something murder when the victims weren't born?
this new law in texas just dumped a bunch of oil on the slope.

i think a lot of states have laws against killing babies in a mothers womb. Scott Perterson was charged and convicted in California with double murder. ( his wife was pregnant when he killed her.)
My interpreting of the law.... is the baby is human if attacked by its father, but non-human if attacked by its own mother and a "doctor".

Haha that has got to be the most ridiculous law I've seen in a long time. It should be completely up to the woman.

I wasn't trying to say there is anything wrong with abortion, as I am firmly pro-choice in the matter and don't consider a fetus to be a "life" on its own (it cannot survive outside the mother's body, so until it can it is a PART of the mother's body).
I just think it's silly to send a guy to jail for life because he performed a crude version of something women are allowed to do in a medical setting. They call it "murder" in one law, and "medical procedure" in another law.

She asked her boyfriend to help her have a miscarriage.
She WOULD have asked a medical profressional to give her an abortion.
She asked BOTH, and BOTH did/would have obliged.
But one gets life, the other gets a check.
Fucking terrible.
