The senate intelligence committee is considering a bill that would make those parts of the PATRIOT act set to sunset permanent, and give the justice department additional powers. If this bill passes unaltered, the FBI will be able to issue secret administrative subpoenas without judicial oversight. So, the police will be able to subpoena any records they want without having to ask a judge, and the organizations subpoenaed won't be permitted to tell anyone that the subpoena occured - though they will be able to take the Justice dept. to court over it.
