how much more information do you need to realize that
this isn't an infringement on the first amendment?

All I know is The Growery is a place where losers who get banned here go.

"In the midst of a libel case, the former editor of the Chanhassen Villager has told contradictory stories under oath: either he wrote an editorial containing false accusations without checking the facts, or he wrote it after he was handed a file that would've proven him wrong.

Eric Serrano's editorial focused on Tom Workman, a local politician who left the Minnesota House and became Carver County board chairman. One of the first things Workman did when he became chairman was get longtime county administrator Richard Stolz fired.

The editorial suggested that Workman had Stolz fired because of a personal grudge. Serrano wrote that Workman lost a lawsuit the county had filed against him, but in reality, Workman worked for a firm that had sued the county and won.

Workman filed a libel lawsuit against the Chanhassen Villager, the Chaska Herald and their parent companies, claiming the defendants acted with "actual malice" -- knowing that such statements were false, and/or with a deliberate disregard for whether its statements were false. The lawsuit seeks actual damages of more than $50,000 and punitive damages of more than $50,000, with the actual amount to be determined at trial.

In pretrial testimony, Serrano said he checked the facts of the case. But last week, he told jurors he hadn't, the Star Tribune reported in its Sunday editions.

"I thought everything in there was right," he said. There seemed to be "no reason to fact check it," he said."
