Growing in an apartment.
    #3508441 - 12/16/04 01:22 PM (12 years, 11 months ago)

I have a question...currently we are going to be having our apartment inspected by the apartment people or whatever....they said they are checking all fire alarms and sinks.....my "room" I use contains a fire alarm. When the come do they have a right to unlock the lock on my door and enter without my permission? Is that against the law? Please respond I am kinda worried to what might happen while im at work!!!!!!!!

no, its legal. make sure that you are there and that everything is stashed in a
closet, place a lock on the closet if you feel you must but get it out of the
areas where that they will be checking, check your local laws and your lease,
it is the right of the management to inspect at any time with a 24/hr notice

if you feel it cant be mmoved, you need to find a method of comoflauge that will
reduce the chance of discovery or get it the hell out of there.

"In plain view"

They cannot move/open/touch anything--only look. So conceal everything and you'll be fine.

I think dobinky hit the nail on the head. Just conceal it, Im sure they will find a lot of suspisious looking things in your neighbors apartments as well, they wont touch however. GL man.

if they give you sufficient notice, they can enter. some states its 72/hr
in others its 24 hours... they are not allowed to snoop through your stuff

they are not allowed to by law but if there is something that is unususal or
that they believe can ba hazardous they have a right to protect themselves and
investigate further.

would you think a 6'4'2' martha covered in a cloth with tubes and power cords running into it would look "unususal or
that they believe can be hazardous"?

Probably is. All im suggesting is that you keep it out of their path. Away from where they will be walking and checking fire alarms. Im a firm believer in "Out of sight, Out of mind".

If anyone every asks me whats up with all the tubs and equipment in my place, I just look them in the eyes and say that I was learning to grow oyster mushrooms (which isnt really too far from the truth). Shrug it off and change the subject, works great. >=)

Personally I don't believe that a landlord who is overcome with curiosity stemming from something in your place is going to abide by any law and not look what's going on. You can't trust anything, especially if you're in America.

My landlord is coming in here over the next couple of days to check my pipes and outlets. I have a key lock installed on my walkin closet, but what I really want is a lockable terrarium. I'm thinking about getting one of those garden/deck storage cabinets that can be locked.

they shouldn't need to. when you rent the apartment they keep a copy of the key to your door, just in case they ever need to get in for maintenance or something like that. if they ever need to get into your apartment for some reason and they can't get in because you changed the locks, they'll probably just get real pissed off and break the door down (changing the locks is illegal).

Keep in mind your right against illegal search and seisure applies only to police. There are other laws for everyone else like landlords, and they have much more leeway then the cops. Keep everything suspect out of site, in closets or tubs. People use those tubs all the time for storage.

Recently people came and looked at our smoke detectors as well but my grow is completly hidden in closets and such..there where however over 30 assorted pipes and bongs about that were just quickly covered (coffee table with glass middle that displays them, plus a few strewn about stuck wherever)..they were in for a few seconds pushed the button, it made a noise..they left. Probably not even in the apartment for 60 seconds total. Take whatever from that you want

I had a landlord that came in and snooped all the time. I'd put tiny bits of paper between the door and the jamb when I left. Sure enough, when I came back they would be on the floor. I confronted him, and he gave me shit about having the right to inspect his property.

Sure I could have gone to the law. I couldn't see that it would do any good. I couldn't stand the guy and didn't want to live there anymore, so I moved. Hmmmm. Now that I think about it, I might have left the water on.

in my state the law is that they can enter the property if they are doing maintenance as long as they give 48 hours notice, even if you are not home. And guess what, you just got notice. You would be wise to cover up that shit as best as you can, or better yet, get it the hell out of there. The last thing a land lord wants is a criminal tenant. They WILL call the police if they think anything is up. Oyster mushrooms are not a valid excuse for somebody who probably looks like they prefer other kinds of mushrooms.

If I was you, I would be scrambling right now...
