Brian Hornbeck, 19, Rapid City, pleaded guilty on Monday to a charge of possession of a controlled substance ? psilocybin mushrooms.
After hearing that Hornbeck attends college in Huron and would lose grants if convicted of a felony, 7th Circuit Judge Thomas Trimble allowed the defendant's criminal record to be sealed if he successfully completes three years' probation.
Conditions of probation are that Hornbeck must stay in school or be employed full time, have a chemical dependency evaluation and follow through with recommendations, and serve 30 days in county jail after the current semester has ended. He also must pay a $500 fine and attorney's fees.
