Hello just want to announce that i pushed my tub deepr in the other tub. I measured temps @ the bottom of the incubation top and in the higher part. At the bottom temp was about as it should be, 86F/30C, but in the higher parts of the tub the temp was below 80F/26C.
So i tied them tight! 
See what happens....

no I dont say that, dont put the words in me mouth fellah! 
Cause I dont have a real lid but I have it covered with a dark plastic bag, the heat escapes a bit and since the heat is coming from downside its warmer in the bottom and colder up there. Where the outside temp is like 75-77 F.
My TIT is like the alps! ;P
Interesting huh? hehe

Guess what? The temp above the jars has raised after i tied the tubs more tight together! First it was like 25,5 now it is 27,5 there. Interesting huh Hyphae ? In F from 77 to 82. In only a couple of hours.

the water level has to be as high as the top of the jars, it still wont be the same temp at the bottom as the top since the volume of water at the bottom is still greater than that of the sides.

Can I lay my jars on their sides during incubation if the water doesn't reach all that far up the sides of the TiT?

Sure, I believe you. And makes sense since the waterlayer between the tubs at the sides is thin. But it is warmer then with the tub floating.
There was some splittring here, if one needs to push his tub in the water instead of just floating it. One maybe doesnt need to, but I found out that in my floating tub the temperature was lower, only a few inches higher in the tub. A difference of 5 Degrees celsius. (about 9 F)
I will be having my "jartub" as deep in the "watertub" as possible. It was a matter of 5 minutes taking some tie straps and putting them in place.

You can, as far as I know.... Maybe your vermlayer will fall down a bit, so bit less protection against contams.
If I were you id just sink teh tub a bit deeper and/or use a kinda airtight lid on ur "jartub".
