Stopped by a cop

Is it considered probable cause to be going for a walk at 4 in the morning? That's what I was doing just now, when a cop car pulled up and the cop questioned me. Regretfully, I consented to a search. I didn't have anything on me, and wasn't doing anything illegal, but still, I really wish I hadn't forfeited my Constitutional rights. I'm not in trouble or anything, but now the police have a file on me. One more reason to never consent to a search.

I got followed by the cops once when i went out to walmart in the middle of the night on a bicycle... he followed me all the way up to walmart, followed me all the way back, then he stopped me on the pretense that a 'bicycle thief' was lurking the neighborhood and he wanted to check out my bike... totally bogus, but he didn't ask to search me...
I found out later that the same cop works for the crack dealers, guarding the crackhouse. He probably thought I was out looking for crack, and stopped me with the intention of robbing me of my crack booty... or mebbe he wanted my booty crack? I dunno...
cops can be assholes...

I heard from a friend that cops often depend on people "getting caught in the headlights" like a deer. Like when cops ask to search your person, you have to react quickly. Its best tho to consent if you dont have any weed or anything on you. It just looks better. Here though there's always people walking around at any given time so its not much of an issue.

Yes - in fact I said something similiar in the same situation.. "Why would you want to search me?" the conversation went off track from there and they never searched me.. at that time I had a eigth of mushrooms in my pocket so I think I played it pretty well then.

I went to the movies on a Sunday night years back and caught the last show which let out at midnight. I was walking home and was tailed by a lady cop in a patrol car. She pulled over.
LC: What are you doing?
Swami: Going for a walk
LC: Where you going?
Swami: Home.
LC: What is your name?
Swami: I am not required to give you that information.
LC: May I see some ID?
Swami: No, you may not.
LC: Do you have a problem with police?

A few minutes later, a short, Hispanic, barrel-chested cop pulls up and flies out his car enraged and jumps in front of me on the sidewalk blocking my path with folded arms.
HC: *angrily* I hear that you are giving my partner some sheet!
Swami: Nothing of the sort.
HC: WTF are you doing in my neighborhood?
Swami: I am going for a walk.
HC: Why didn't you show her your ID?
Swami: Because I am not required by law to do so.
HC: I am staring to really dislike you.
Swami: You are hurting my feelings.
HC: Don't get smart with me asshole.
Swami: OK, Officer Hernandez, badge number 381, you have two options: either arrest me and I will not resist; or get out of the way and let me pass. I don't care what you do, but detain me any longer and I am filing a harassment complaint.
HC: We will be keeping an eye on you.
Swami: I will sleep better at night knowing that. May I pass now?
HC: *grudgingly steps aside.*

I was talking a walk last night and talking on my cell phone and this police car just rolls up to me. The guy asks if I live around here. I have one of those earpiece things for my phone, and as soon as I take it out he says "never mind" and drives off. I guess he thought I was schizophrenic talking to myself.

I remember reading the court docs for that last summer. My opinion is that if the cops have to know your name to find something to arrest you for on a random stop, they need to try harder at their jobs. I would consider my name/id to be protected by the 4th amendment and not subject to unreasonable search. Unfortunately those pesky activist judges think otherwise.

I don't think the distinction between voluntary and involuntary actions is that clear. Consider cross-country transportation. To have a car, you need a license, and a license plate. To ride a plane, you need to present ID. Hitchhiking is illegal. I'm not sure about busses, but if you refuse to present ID, they likely won't sell you a ticket. Each, individually, is a voluntary action. Collectively, they have the result that the government would be able, if they cared to, to track your individual movement within the country. A long time ago I ACTUALLY respected cops until I was arrested on a rape charge. It was one of the worst nights of my life. The cops were very psychologically abusive. There were 18 (yes - eighteen!) cars in front of my house. I was kept outside shirtless for four hours in 40 degree weather. Later they drove me 20 miles to the jail EVEN THOUGH the victim told them it wasn't me!
I was never booked nor even take into the building. It was just a "Hey, let's-fuck-with-this-hippie" thang. After non-stop intimidation they drove me back home and said, "Have a nice day!"

Maybe there's good, but a cop has NEVER to my knowledge done a single thing positive for me.
Every encounter with the men-in-blue has been neutral at best or negative. As to cirme, I have been victimized 6 major times. The guys were never caught. Not sure what benefit I do get from my tax dollars. The only thing I can think of is the police stop some drunk drivers from endangering the rest of us.

Police provide a collective order in a society. If you are assaulted, the police will assist you. If you assault someone, the police will arrest you and charge you - and so forth. The law serves to protect and preserve human life.

It's a little more involved than that. Basically states can decide if an officer can require you to identify yourself or not. The Supreme Court didn't decide that you have to identify yourself only that a state may decide for itself. Nevada already had a law stating you did and that was the Supreme Court upheld.
Also "identify" doesn't specifically mean show a driver's license. As long as you identify yourself in one way or another IF your state has a law stating you must you are in compliance.

Cops can be plain incompetent, and since they are never on your side you should never say anything. I actually was arrested and put in jail overnight on Proboble Cause for driving under the influence of marijuana when I had no weed in my car and I hadn't smoked in days. They pulled me over for a burnt headlight, decided I was high and hauled me off. It was pretty ridiculous and quite surreal. The officer said my car smelled profusely of marijuana, though nobody has ever smoked in it.
I had to pay $1000 for a lawyer, and after the prosecuters stalled for two months we were able to obtain a copy of my 100% clean blood test report. The police department was withholding the evidence and would have done so indefinately putting me through endless hearings and risk of conviction on circumstancial grounds because they didn't want to admit they were totally incompetent.

The only good thing a cop has done for me was in my grade 6 VIP class when I learned about all the different kinds of drugs out there and opened another door for my curiousity. Other then that all they've done was bust partys, take my booze, give me fines, and waste my time.

Man thats nothing. i had the secrete service tear my apartment apart w/o a warent or even asking if they could. those jerks badgered me and my family freinds and co workers for months, when i had done nothing. i regret not getting a lawure and doing somthing about the illegal search, but they told me due to the patriot act they could search me without a warrent, but they also said i couldnt ell anyone what happened. once i started telling people they started to leave me alone

That story is a good example of why women should not be allowed to be police officers. That guy was trying to act all extra beefy because you disrespected a lady. You're always supposed to do what women tell you do do. It's the law.

my buddy got arrested her recently and was talking mad shit to both cops. the female was hand cuffing him and searching him, and the male walked away. she got scared and told the male cop to come back because she said she didnt feel safe searching my buddy alone. and the guy cop laughed and told her she would be ok. my buddy was like, you never know what i might do to a cop, so you might want to protect her. and the guy didnt take up for her at all. my buddy and most of my freinds hate cops. the insults and sarcsm he gave them was clasic. too bad he went to jail for 8 days
